A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
APPROVING THE MUTUAL AID AGREEMENT PROVIDING FOR EMERGENCY
ASSISTANCE AMONG THE MEMBER AGENCIES OF THE
SAN DIEGO COUNTY WATER AUTHORITY
WHEREAS, the San Diego County Water Authority recognizes the
fact that all imported water supplies for San Diego County are
potentially vulnerable to earthquakes and other emergencies, and
desires to establish a mutual aid plan to maximize the utilization
of available water supplies and distribution facilities to
conserve, allocate, and distribute water equitably to its member
agencies in the event of catastrophic interruption to normal
production and/or delivery facilities; and
WHEREAS, mutual aid is defined as emergency assistance given
from one member agency to another, under a prearranged agreement;
and
WHEREAS, it is desirable that each of the member agencies of
the San Diego County Water Authority (#SDCWA"), should voluntarily
aid and assist each other both in preparation for an emergency and
in response to any emergency situation, or extraordinary or unusual
circumstance, such as in the event of an earthquake, flood, fire,
sabotage, riot, or other regional emergency; and
WHEREAS, materials, facilities, services, equipment and/or
personnel are provided on the basis that the providing agency can
still continue operations and the receiving agency has, or is about
to, exhaust all resources; and
WHEREAS, the member agencies are each willing to assume risks
due to the use of defective items furnished by other member
agencies; and
WHEREAS, each of the member agencies agree to indemnify and
hold each other harmless from any liability for injury, illness, or
property damage incurred by any other member agency or its
employees, officers or agents, or by third parties in the course
of, or as a result of member agency activities; and
WHEREAS, this Agreement is not designed as a joint use or
joint purchasing program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF POWAY, CALIFORNIA:

Section 1. That the San Diego County Water Authority Mutual
Aid Agreement providing for emergency assistance among its member
agencies is hereby approved, and the City Manager be authorized to
execute the Mutual Aid Agreement, attached as Exhibit A to this
resolution, on behalf of the City of Poway.
PASSED, ADOPTED, and APPROVED by the City Council of the City
of Poway, Cal ifornia, at a regular meetii~g~day of
October, 1992.
