Res 92-199RESOLUTION NO. g2-199 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL AND SPECIAL MUNICIPAL ELECTIONS HELD IN SAID CITY ON NOVEMBER 3, t992, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS ARE PROVIDED BY LAW WHEREAS, a regular general municipal and a special municipal election were held and conducted in the City of Poway, California, on Tuesday, November 3, 1992, as required by law; and WHEREAS, notice of said elections were duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and tha~ in all respects said elections were held and conducted and the votes cast there at, received and canvassed and the returns made and declared in time, form and manner as required by the provi- sions of the Elections Code of the State of California for the holding of elec- tions in cities; and WHEREAS, pursuant to Resolution No. 92-087 adopted June 9, 1992, the Registrar of the County of San Diego canvassed the returns of said election and has certified the results to this City Council, said results are received, attached and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That there were thirty (30) voting precincts established for the purpose of holding said election consisting of consolidations of the regular election precincts in said City. Section 2. That said regular general municipal election was held for the purpose of A) electing Two (2) members of the City Council of said City for the full term of four years; and B) deciding on Ballot Proposition S "Shall an ordi- nance of the City of Poway be adopted which would require voter approval of land use changes which would permit an asphalt plant in the South Poway Planned CofFmiiunity?" Section 3. That said special municipal election was held for the purpose of electing one (1) Mayor for a short term of two years. Section 4. That the number of votes cast in said City (except absent voter ballots) was 15,874. That the number of votes cast absentee was 5,288. The total votes cast were 21,162. Section 5. That the names of persons voted for at said election for Mayor and Member of the City Council of said City are as follows: -- Resolution No. 92-199 Page 2 For Mayor: William Hickey 5,306 Don Higginson 13,619 For City Council: Susan Callery 8,745 Howard Collins 2,021 Robert Emery 11,665 Victoria "Vicki" Lazowski 5,304 Judy Mantle 5,332 Section 6. That the votes for and against Proposition IISII are as follows: Yes 14,174 No 5,270 Section 7. The City Council does declare and determine that: Don Higginson was elected as Mayor of said City for the short term of two years; Susan Callery was elected as Member of the City Council of said City for the full term of four years; Bob Emery was elected as Member of the City Council of said City for the full term of four years; Proposition "S" was approved. Section 8. The City Clerk shall enter on the records of the City Council of said City, a statement of the result of said election, showing: (1) the whole number of votes cast in the City; (2) the names of the persons voted for; {3) for what office each person was voted for; {4) the number of votes given at each precinct to each person; {5) the number of votes given in the City to each person; Section 9. That the City Clerk shall immediately make and deliver to each of such persons so elected, a Certificate of Election signed by the City Clerk and duly authenticated; that the City Clerk shall also administer to each person elected, the Oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in the office of the City Clerk. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. Resolution No. 92-199 Page 3 Section 10. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
