AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA,
APPROVING SPECIFIC PLAN AMENDMENT 13 -002
TO THE SOUTH POWAY SPECIFIC PLAN
TO CHANGE THE LAND USE DESIGNATION
FROM LIGHT INDUSTRIAL TO LIGHT INDUSTRIAL - STORAGE
ON A 0.33 -ACRE SITE LOCATED AT 12125 PAINE STREET
APN: 317- 271 -63
WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning
Development Code) of the Poway Municipal Code provides the requirements for the
preparation and adoption of Specific Plans in accordance with Title 7, Division 1,
Chapter 3, Article 8 (Section 65450, et seq.) of the California Government Code (Article
8, Specific Plan); and
WHEREAS, McElwee Family Trust, ( "Applicant ") has submitted a request,
Specific Plan Amendment (SPA) 13 -002, to change the Land Use Designation on a
previously developed, approximately 0.33 -acre property located at 12125 Paine Street
in the Poway Business Park, from Light Industrial (LI) to Light Industrial- Storage (LI -S);
and
WHEREAS, on July 16, 2013, the City Council held a duly advertised public
hearing to receive testimony from the public, both for and against, relative to this
application.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS:
Section 1: The proposed project is Categorically Exempt as a Class 1 Categorical
Exemption from the California Environmental Quality Act (CEQA) pursuant to Section
15301(e) of the 2013 CEQA Guidelines, in that the proposed project involves a change
in land use designation with only negligible expansion of the existing use. Specifically,
the City Council finds that the proposed addition to the existing structure will not result in
an increase of more than 50 percent of the floor area space or 2,500 square feet,
whichever is less. The City Council further finds that (1) there is no reasonable
possibility that the project will have a significant effect on the environment due to
unusual circumstances; (2) the proposed project will not result in damage to scenic
resources; (3) the proposed project is not to be used for a project located on a
hazardous waste site; and (4) the proposed project will not cause a substantial adverse
change in the significance of a historical resource.
Section 2: The City Council finds that the proposed amendment to the South Poway
Specific Plan (SPSP) to change the land use designation on a previously developed,
approximately 0.33 -acre, property located at 12125 Paine Street in the Poway Business
Park, from Light Industrial (LI) to Light Industrial- Storage (LI -S) is consistent with and
will still promote the systematic execution of the General Plan, in that future
development of the Property will still be subject to applicable General Plan goals and
policies and the Light Industrial- Storage land use designation of the SPSP.

Section 3: The City Council hereby approves Specific Plan Amendment 13 -002
changing the land use designation from Light Industrial (LI) to Light Industrial- Storage
(LI -S) on the property shown in Exhibit A attached to this Ordinance.
EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30)
days after the date of its passage; and before the expiration of fifteen (15) days after its
passage, it shall be published once with the names and members voting for and against
the same in the Poway News Chieftain, a newspaper of general circulation published in
the City of Poway.
Introduced and first read at a regular meeting of the City Council of the City of
Poway held this 16th day of July 2013, and thereafter PASSED AND ADOPTED at a
regular meeting of said City Council held the 6th day of August 2013.
