A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
APPROVING GENERAL PLAN AMENDMENT (GPA) 13 -001
ASSESSOR'S PARCEL NUMBERS: 323 - 203 -18 AND 323 - 203 -19
WHEREAS, GPA 13 -001, submitted by Mark Abelkop /MLGP &L, LLC, Applicant:
is a request to amend the Land Use Element of the Poway General Plan to change the
land use designation of two adjacent vacant parcels located at 13956 Poway Road and
13917 Courier Way from Residential Single - Family 7 (RS -7) to Automotive /General
Commercial (A/GC); and
WHEREAS, the City Council of the City of Poway recognizes that the need may
arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code
describes the procedures for amending General Plans; and
WHEREAS, on August 6, 2013, the City Council held a duly advertised public
hearing to solicit comments from the public, both for and against, relative to this
application.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway as follows:
Section 1: The City Council has considered the Environmental Initial Study (EIS) and
Negative Declaration (ND) for GPA 13 -001, and public comments received on the EIS
and ND. The subject EIS and ND documentation are fully incorporated herein by this
reference. The City Council finds, on the basis of the whole record before it, that there
is no substantial evidence the project will have a significant impact on the environment,
and that the ND reflects the independent judgment and analysis of the City. The City
Council hereby approves the Negative Declaration. Future development of the property
will be subject to additional environmental review.
Section 2: The City Council finds that the proposed GPA, and the corresponding
Zone Change 13 -001, would maintain land use compatibility with the surrounding
properties and provide an expanded list of potential land uses available to development
located on the subject parcels.
Section 3: The City Council hereby approves GPA 13 -001, an amendment to the
Land Use Element of the Poway General Plan, re- designating the land use of two
adjacent vacant properties located at 13956 Poway Road and 13917 Courier Way from
RS -7 to A/GC as shown on Exhibit A.
