Ord 754ORDINANCE NO. 754 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA, CHANGING THE ZONING DESIGNATION OF CERTAIN PROPERTIES (ZONE CHANGE (ZC) 13 -001) ASSESSOR PARCEL NUMBERS: 323 - 203 -18 AND 323 - 203 -19 WHEREAS, Chapter 17.06 of Title 17 (Zoning Development Code) of the Poway Municipal Code (PMC) provides the requirements for the establishment and amendment of zoning districts; and WHEREAS, Mark Abelkop /MLGP &L, LLC, ( "Applicant ") has submitted a request to change the land use and zoning designation of two adjacent vacant parcels located at 13956 Poway Road and 13917 Courier Way from Residential Single - Family 7 (RS -7) to Automotive /General Commercial (A/GC); and WHEREAS, on August 6, 2013, the City Council of the City of Poway approved General Plan Amendment (GPA) 13 -001, a request to amend the land use of the two adjacent vacant parcels located at 13956 Poway Road and 13917 Courier Way from residential to commercial; and WHEREAS, the City Council finds that the zoning designation of the properties should also be changed to maintain consistency with the General Plan, as required by Section 65860 of the California Government Code and the California Environmental Quality Act (CEQA); and WHEREAS, on August 6, 2013, the City Council held a duly advertised public hearing to solicit comments from the public, both for and against, relative to this application. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: Section 1: The City Council has considered the Environmental Initial Study (EIS) and Negative Declaration (ND) for GPA 13 -001 and ZC 13 -001, and public comments received on the EIS and ND. The subject EIS and ND documentation are fully incorporated herein by this reference. The City Council finds, on the basis of the whole record before it, that there is no substantial evidence that the project will have a significant impact on the environment. Future development of the property will be subject to additional environmental review. Section 2: The City Council hereby amends the City of Poway Zoning Map as follows: The zoning of two adjacent vacant parcels located at 13956 Poway Road and 13917 Courier Way is changed from Residential Single - Family 7 (RS -7) to Automotive/ General Commercial (A/GC) as shown on Exhibit A, attached hereto and incorporated here by this reference. Ordinance No. 754 Page 2 EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30) days after the date of its passage; and before the expiration of fifteen (15) days after its passage, it shall be published once with the names and members voting for and against the same in the Poway News Chieftain, a newspaper of general circulation published in the City of Poway. Introduced and first read at a regular meeting of the City Council of the City of Poway held the 6th day of August 2013, and thereafter PASSED AND ADOPTED at a regular meeting of said City Council held this 20th day of August 2013.
