A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
ESTABLISHING A TIERED WATER RATE STRUCTURE
FOR STAGES V THROUGH VII
OF THE ?-STAGE WATER CONSERVATION ORDINANCE
WHEREAS, the City Council adopted Ordinance No. a~R , a 7-
stage Water Conservation Plan, on March 16, 1993 ; and
WHEREAS, the City Council desires to establish a tiered
billing structure for all water customers under Stages V through
VII of the Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Poway:
Section 1. That the tiered water rate schedule is hereby
established as follows for all water billed after the date that
the Council declares a water shortage is in effect at Stages V
through VII and will remain in effect until such time as said
declaration is rescinded. This tiered water rate schedule shall
be applied to the basic water rate in effect at the time of the
declaration or as subsequently changed by resolution.
A. Basic Water Rate
The basic water rate for all classes of service including
agricultural and agricultural-domestic shall be the per unit rate
established by the City Council annually by resolution.
B. Tiered Rate Structure
The tiered rate structure shall apply to all classes of service
including agricultural and agricultural-domestic water service.
The tiered rate structure shall consist of three tiers billed as
follows:
Tier 1 1 times the Basic Water Rate for initial water allocation
Tier 2 1.5 times the Basic Water Rate for the next 10% of the
base year consumption
Tier 3 3.0 times the Basic Water Rate for all remaining water
consumption
C. Single Family Dwellinqs
1)
The water allocation per billing period for a single
family residential dwelling shall be calculated as
follows:

a) A lifeline allocation of 235 gallons per day per
dwelling.
b)
An additional lifeline allocation of 55 gallons per
day for each person over four residing in the home
may be granted if the home has been retrofitted with
ultra low-flow toilets and shower heads.
c)
An additional environmental allocation for each
dwelling, not to exceed 3000 gallons per day,
calculated as follows:
1989 base period water use less the lifeline
allocation multiplied by the environmental
allocation percentage.
The 1989 base period calculation will use water
consumption from May 1, 1989 through April 30, 1990.
If inadequate information is available for that time
period, the City will use calendar year 1990 water
consumption or will calculate a base year using an
allocation table.
d) The environmental allocation percentage at each
stage shall be:
Stage V 50%
Stage VI 30%
Stage VII 15%
D. Ail Other Service Types
The allocation for all other service types will be based upon a
percentage of the water consumption for the same period of time
in 1989-90 (May 1, 1989 through April 30, 1989). If inadequate
information is not available for that same period, the City will
use calendar year 1990 service or calculate a base year using an
allocation table.

E. Special Circumstances
Water customers may request additional water allocations due to
special circumstances as follows:
Large Livestock
25 gallons per day per animal (horses must be
licensed)
Day Care
10 gallons per day per child (for day care up
to the maximum allowed under license)
Births
55 gallons per day per infant (if birth
brings size of family residing in dwelling
above four)
Medical
Reviewed on case-by-case basis. Must have
physicians statement as to need.
No 1989 Service
Use 1990 service or calculate base year using
an allocation table
Requests for increased allocations due to special circumstances
as described herein shall be submitted to the City Manager in
writing pursuant to Section 5 of City of Poway ordinance No. 336.
The City Manager or his designee shall grant or deny such
requests within thirty (30) days of their receipt. The decision
of the city Manager may be appealed pursuant to Section 7 of City
of Poway Ordinance No. 336.
F. Other Water Charges
Ail other water charges; i.e., basic service charge, pumping
charges, delinquency charges, etc., in effect at the time of the
declaration shall remain in effect and be charged at those rates.

Section 2. That the setting of such charges and rates is
categorically exempt from the requirements of CEQA, pursuant to
Sections 21080(b) (4) and (b) (8) (1) and (2) and Section 21060.3 of
the Public Resources Code, and Title 14 of the california Code of
Regulations, Section 15269(c) and 15273(a) (1) AND (2) AND 15307.
PASSED, ADOPTED AND APPROVED by the City Council of the City
of Poway, California, at a regular meeting thereof this 16th day
of March, 1993. This resolution will become effective the same
date as Ordinance No. ~8, the 7-stage Water Conservation Plan.
