• A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE MASTER FEE SCHEDULE
TO WAIVE THE MINOR DEVELOPMENT REVIEW APPLICATION FEE
FOR AMATEUR RADIO ANTENNAS UP TO 35 FEET IN HEIGHT
WHEREAS, on May 4, 2010, the City Council adopted a Master Fee Schedule;
and
WHEREAS, California Government Code Section 66016, et seq., establishes
procedures for the adoption of fees for services provided by local government; and
WHEREAS, the established fee for a Minor Development Review Application for
an amateur radio antenna is $719; and
WHEREAS, the City Council of the City of Poway wishes to accommodate
amateur radio antennas up to 35 feet in height by waiving the Minor Development
Review Application fee for such antennas; and
WHEREAS, the City Council recognizes that amateur radio operators serve a
valuable public service in time of emergency, and were invaluable during the Witch
Creek Fire in 2007, by providing an inexpensive and reliable network of communication
for the City and the public when other communication resources were overwhelmed or
otherwise unavailable.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: The City Council finds that this amendment to the Master Fee Schedule is
exempt from the requirements of CEQA pursuant to CEQA Guidelines Section 15273
(a)(1) because it amends a fee necessary to meet the City operating expenses to
process Minor Development Review Applications.
Section 2: The City Council hereby finds that there is a valid public purpose in
waiving the Minor Development Review Application fee for amateur radio antennas up
to 35 feet in height as it assists amateur radio operators to improve their communication
facilities, to reach the public through a reliable mode of communication in times of
emergencies affecting the residents of the City of Poway and the greater San Diego
County region, especially when other forms of communication fail.
Section 3: The City Council hereby modifies the fee in the Master Fee Schedule for
Minor Development Review Applications for amateur radio antennas up to 35 feet in
height as shown on the attached Exhibit A.
