COVENANT REGARDING REAL PROPERTY
Todd Kroepel and Tricia Kroepel, Husband and Wife, and Larry Kroepel, a married man as his sole and
separate property, as Joint Tenants, ( ,'OWNER" hereinafter) are the owners of real property commonly known
as 16447 Martincoit Road ( "PROPERTY hereinafter) and more fully described as:
Parcel 40 as shown on Record of Survey Map No. 3897, in the County of San Diego, State of
California, filed in the office ofthe Recorder of San Diego County, April 10, 1956, said Record of
Survey Map No. 3897, being a survey of a portion of Sections 25 and 36, Township 13 South,
Range 2 West, San Bernardino Based and Meridian, according to the official plat thereof.
In consideration of the approval of a Building Permit to construct an approximate 616 - square -foot, detached,
non - habitable accessory structure on the above- referenced property by- -the City of Poway ( "CITY" hereinafter),
OWNER hereby agrees that the non- habitable accessory structure shall never.be converted to living; space and
no heating or air conditioning installed without first obtaining approval and appropriate permits from CITY, that
the accessory structure shall never be rented or leased as a separate unit, and no gas line and /or 220 ampere
electrical service shall be installed.
This Covenant shall run with the land and be binding upon and inure to the benefit of the future owners,
encumbrances, successors, heirs, personal representatives, transferees and assigns of the respective parties.
In the event that a Building Permit is never obtained to construct the proposed structure at the request of the
OWNER, the CITY shall expunge this Covenant.from the record title of the PROPERTY.
If either party incurs costs as a result of filing a civil action to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the
other party.
