Covenant Regarding Real Property 2013-0621397COVENANT REGARDING REAL PROPERTY Lance Rankin, a married man as his sole and separate property, ( "OWNER hereinafter) is the owner of real property commonly known as 18765 Heritage Drive ( "PROPERTY hereinafter) and more fully described as: Lot 25 of Poway Tract No. 98 -02 Heritage Ranch Estates, in the City of Poway, County of San Diego, State of California, according to the map thereof No. 14388, filed in the office of the County Recorder of San Diego County, May 8, 2002. In consideration of the approval of a Building Permit to construct an attached, guest house at the above - referenced property by City of Poway ( "CITY" hereinafter), OWNER hereby agrees that the guest house shall never have kitchen facilities installed and that.the guest house will not be rented or leased as a separate unit. This Covenant shall run with'the land and be binding upon and inure to the benefit of future owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the respective parties. In the event that a Building Permit is never obtained to construct the proposed guest house at the request of the OWNER, the CITY shall expunge this Covenant from the record title of the PROPERTY. If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party.
