Res 93-120RESOLUTION NO. 93420 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING SECOND AMENDMENT OF THE SOLID WASTE INTERIM PARTICIPATION AGREEMENT Whereas, the proposed second amendment to the Solid Waste Interim Agreement is necessary to obtain the participation of the cities throughout the County and is in the best interest of the City of Poway. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY HEREBY FINDS, RESOLVES, DETERMINES AND ORDERS AS FOLLOWS: 1. Section 2.1 shall be replaced with the following language: This INTERIM AGREEMENT shall take effect as of June 22, 1993, by between among the COUNTY and any of the cities listed on Attachment A as having executed this document on or before August 27, 1993. 2. Section 3.8(a)(1) shall be replaced with the following language: No Bond Issue. As to all members, on May 31, 1994, unless the COUNTY first relies on the Flow Control Covenant in issuing bonds to finance the San Marcos facility expansion and/or closure and to provide financing for other solid waste projects in the approximate amount of $60 to $100 million; the COUNTY agrees that it will not issue solid waste facility bonding prior to June 1, 1994, without the concurrence of a majority vote of the members of the Interim Commission.
