A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
ESTABLISHING A POLICY CONCERNING
REMOVAL OF COASTAL SAGE SCRUB
OF LOWER POTENTIAL VALUE
WHEREAS, the United States Department of the Interior, Fish and Wildlife Service
has listed the California gnatcatcher as a threatened species and has proposed a special
rule which provides recognition of the regional conservation efforts already under way
including the Natural Communities Conservation Program; and
WHEREAS, the proposed special rule includes a ranking system for coastal sage
scrub habitat which describes criteria for habitat of "higher potential value," "intermediate
potential value," and "lower potential value"; and
WHEREAS, the proposed special rule provides for an interim loss cap of 5
percent of the total coastal sage scrub; and
WHEREAS, any coastal sage scrub removed under the interim loss provision
should be from the lower potential value category as determined by a qualified biologist
recognized by the US Fish and Wildlife Service; and
WHEREAS, the Fish and Wildlife Service has indicated that the removal of coastal
sage scrub which is not currently occupied by gnatcatchers is not a violation of the
Endangered Species Act.
NOW, THEREFORE, the City Council does hereby resolve that clearing, grubbing
and/or grading permits may be issued which would allow the removal of up to 5 percent
of the total coastal sage scrub within the city limits of the City of Poway and that all
coastal sage scrub so removed shall meet the criteria for the "lower potential value"
category. The City Council further resolves that authorization to remove coastal sage
scrub habitat shall be issued to applicants in the chronological order that applications for
such clearing, grubbing and/or grading permits are received.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 12th day of October, 1993.
