A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
APPROVING THE DEVELOPMENT OF AN APPLICATION TO THE CALIFORNIA
INTEGRATED WASTE MANAGEMENT BOARD FOR RECYCLING
MARKET DEVELOPMENT ZONE DESIGNATION
WHEREAS, California law provides for the establishment of Recycling
Market Development Zones within cities that provide programs and incentives
to stimulate activities that are favorable to development of post-consumer
waste material markets; and
WHEREAS, the success of state-wide implementation of the California
Integrated Waste Management Act of 1989 (AB 939) is directly related to
development of additional markets for post-consumer waste materials; and
WHEREAS, the development of post-consumer waste material enterprises
that use recycled materials to produce secondary products will assist in
protecting the natural environment of the City of Poway while also providing
job opportunities for its citizens, and
WHEREAS, the siting of post-consumer waste material enterprises will
encourage other businesses in the City of Poway to purchase products that
are derived from recycled products due to local availability and
distribution of such products, and
WHEREAS, the City Council of the City of Poway desires to initiate
steps to create a Recycling Market Development Zone within the City;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Poway, California, does hereby resolve that:
Section 1: The current and proposed waste management practices and
conditions in the region are, and will be, favorable to
the development of post-consumer waste materials markets.
Section 2: The designation of appropriately zoned parcels within the
City of Poway as a Recycling Market Development Zone is
necessary to assist in attracting to the proposed zone,
private sector recycling business investments and
manufacturers of products that use recycled materials (or
derivatives therefrom) as "raw materials."
Section 3: Approval is granted to complete all actions stated within
an application to be developed which will apply to the
jurisdiction, should the application area be awarded
Recycling Market Development Zone designation.

The City Manager shall submit to the City Council for
final review and approval, the application before it is
forwarded to be developed to the California Integrated
Waste Management Board.
The City of Poway shall file an application for Recycling
Market Development Zone Designation as such application
is on file in the Office of the City Clerk.
The City Manager or authorized designee as agent of the
City, shall coordinate, process, and execute all
contracts, agreements, amendments, and ancillary
documents within the scope of the final approved
application for Recycling Market Developments Zone
designation.
PASSED, ADOPTED, and APPROVED by the City Council of the City of Poway
at a regular meeting thereof this 2nd day of November, 1993.
