A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF POWAY, CALIFORNIA
DETERMINING THAT THE NEW POWAY LIB~RY FACILITY
IS OF BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT
WHEREAS, the Poway Redevelopment Agency is authorized to carry out the
redevelopment of the Poway Redevelopment Project Area; and
WHEREAS, the Poway Redevelopment Agency has undertaken a study to determine
the needs of the community and has concluded that an expanded library facility
is necessary; and
WHEREAS, the location of the new Library Facility (the "Project") is
outside of the Paguay Redevelopment Project area, the Project location is
adjacent to the Project area, provides a benefit within the Project Area and is
necessary for the execution of the Project under the provisions of the California
Community Redevelopment Law (Health and Safety Code, Section 33000 et. seq.) and
pursuant to the Redevelopment Plan for the Project, which was adopted on December
13, 1983, by Ordinance No. 117 of the City Council; and as amended on June 15,
1993, by Ordinance No. 415 of the City Council; and
WHEREAS, Section 33445 of the California Health and Safety code requires
the Agency to determine the issue of benefit to the Paguay Redevelopment Project
prior to the acquisition of the site and that no other reasonable means of
financing are available.
NOW, THEREFORE, IT IS RESOLVED that the City Council of the City of Poway
does hereby resolve as follows:
Section 1. The City Council hereby determines that the development of the
New Poway Library Facility is of benefit to the Paguay Redevelopment Project and
the surrounding community by providing a larger library facility than the current
Library, providing a more efficient Library facility than the existing Library
facility, and providing the opportunity to implement a wide-range of services
that cannot be offered currently due to physical space limitations.
Section 2. The City Council further determines that no other reasonable means
of financing the improvements are available to the community.
Section 3. The City Council further determines that the future commercial uses
of surplus property resulting from this purchase are also of benefit to the
project area.
Section 4. The City Clerk shall certify to the adoption of this resolution.
