Res 94-051 Resolution No. 94-051 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING THE TRANSFER OF REAL PROPERTY BY THE POWAY REDEVELOPMENT AGENCY TO PERSOPLIS PARTNERS WHEREAS, the Poway Redevelopment Agency (hereinafter referred to as the "Agency") under the provision of the California Community Redevelopment Law, is engaged in activities necessary for the execution of the Redevelopment Plan for the Paguay Redevelopment Project Area (hereinafter referred to as the "Project Area"); and WHEREAS, in order to effectuate the provision of that Redevelopment Plan, the Agency proposes to transfer certain property owned by the Agency within the Project Area, generally described and depicted on the attached Plat Map and Legal Description for Boundary Adjustment BA 91-11 (Exhibit A); and WHEREAS, the transfer of the property to Rahi Nikravesh (hereinafter referred to as the "Participant") constitutes the consideration for Participants granting of a slope and right-of-way easement and permission to grade on his property; and WHEREAS, the transfer of that portion of Assessors Parcel 321-011-02 which is currently owned by the Agency in accordance with the purposes and objectives of the Redevelopment Plan and the Project; and WHEREAS, the City Council has duly considered all terms and conditions of the proposed transfer and believes that the development of the property is in the best interests of the City and the health, safety, morals, and welfare of its residents, and in accord with the public purposes and provisions of applicable State and local law requirements. NOW, THEREFORE, the City Council does hereby find, determine, order, and resolve as follows: Section 1. The recitals hereof are true and correct and are incorporated herein by reference. Section 2. The transfer of the real property by the Redevelopment Agency to the Participant is hereby approved.
