A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
PROVIDING FOR A DRAWING BY LOT FOR
ELECTIVE OFFICES IN THE EVENT OF A TIE VOTE
AT ANY MUNICIPAL ELECTION AND
RESCINDING RESOLUTION NO. 86-071
WHEREAS, Section 20501(b) of the Elections Code of the State of California
authorizes the City Council to determine how a tie vote for an elective office will
be resolved in a municipal election; and
WHEREAS, the City Council has determined that a drawing by lot is desirable
due to the fiscal impact of a special election.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DOES HEREBY
RESOLVE AS FOLLOWS:
1. If two or more persons receive an equal and the highest number of votes
for an office to be voted for within the City, the City Clerk shall conduct
a drawing by lot to resolve the tie vote.
2. Resolution No. 86-071 is hereby rescinded.
PASSED, ADOPTED AND APPROVED at a regular meeting thereof this 2nd day of
August, 1994.
