A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
ORDERING THE EXPANSION OF POWAY
LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 86-1A
WITH THE ANNEXATION OF APN 275-241-01, 36, AND 38 BY
WRITTEN CONSENT OF PROPERTY OWNER
WHEREAS, the City Council of the City of Poway desires to expand Poway
Landscape Maintenance Assessment District 86-1A for the purposes of
maintaining, servicing, and operating said district as shown in Exhibit "A"
pursuant to the Landscape and Lighting Act of 1972; and
WHEREAS, the record owner of all of the real property within said
expansion area has given written consent to the proposed formation and
annexation into Poway Landscape Maintaince District 86-1A pursuant to
California Streets and Highway Code, Section 22608.1; and
WHEREAS, the public interest and convenience require the maintenance,
service and operation of public landscape facilities within said territory.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Poway does hereby resolve as follows:
The foregoing recitals are true and correct and the City Council so
finds and determines.
All of that certain territory shown in Exhibit "A" attached hereto
is hereby added by annexation into Poway Landscape Maintenance
Assessment District No. 86-1A.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this 1st day of November, 1994.

RESOLUTION NO. 94- 109
A RESOLUTION OF THE ciTY COUNCIL OF THE CITY OF POWAY
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT FOR THE EXTENSION OF THE
AFFORDABLE HOUSING ASSISTANCE AND REFERRAL PROGRAM
WHEREAS, the Poway Redevelopment Agency (the "Agency") and LifeLine
Community Services (the "Program Sponsor") are desirous of extending their
existing contractual agreement (the "Agreement") for the provision of the
Affordable Housing Assistance and Referral Program (the "Program") for a period
of one year to assist low and moderate income residents within the Paguay
Redevelopment Project Area (the "Project Area") and the City of Poway (the
"City") in accessing affordable housing; and
WHEREAS, the Program serves as an integral component of a balanced
affordable housing program to increase, and improve, and preserve the supply of
housing in the City available to persons and families with low and moderate
incomes; and
WHEREAS, California Health and Safety Code Section 33334.2(e)(8) states that
the Agency may provide subsidies from its Low and Moderate Income Housing Fund
(the "Housing Fund") moneys to, or for the benefit of, very low, low and moderate
income persons and families to the extent that those households are unable to
obtain affordable housing on the open market; and
WHEREAS, Section 33334.2(g) of the Health and Safety Code authorizes the
Agency to expend its Housing Fund moneys outside the Project Area upon a finding
by the City Council that the expenditure of such funds will be of benefit to the
Project Area;
NOW, THEREFORE, the City Council of the City of Poway does resolve as
follows:
Section 1: The recitals hereof are true and correct and are
hereby incorporated into this Resolution.
Section 2: The City Council finds that the use of the Agency's Low
and Moderate Income Housing Fund to satisfy the Agency's obligations pursuant to
the Agreement are for the purpose of increasing the community's supply of housing
available to persons and families of low and moderate incomes at affordable
housing cost pursuant to California Health and Safety Code Section 33334.2.
Section 3: The City Council hereby authorizes the use of the
Agency's Low and Moderate Income Housing Fund to extend Program services to Poway
residents living outside the Project Area and pursuant to California Health and
Safety Code Section 33334.2(g), the City Council finds that the use of Agency
funds for the Program will be of benefit to the Project Area and to areas outside
of the Project Area within the community.

Section 4: The City Council authorizes the City Manager to execute
a contract agreement for a one year extension of the Affordable Housing
Assistance and Referral Program, as approved in the Resolution of the Agency
adopted on this date and to execute such other documents as may be determined by
the City Attorney to be necessary or appropriate to effectuate the Agreement.
