SUBJECT: Temporary Use Permit 03-18, Poway Chamber of Commerce, Applicant
ABSTRACT
This is a request for a Temporary Use Permit to hold the annual Poway Spring Fest Street Fair along
Midland Road, on Sunday, April 27, 2003, from 10:00 a.m. to 4:00 p.m. The event will include 200
booths, a kid's zone behind Wal-Mart and a stage for live entertainment. Section 17.26.030.A of the
Zoning Ordinance requires that all outdoor entertainment events be reviewed and approved by the
City Council through a Temporary Use Permit.
ENVIRONMENTAL REVIEW
This proposed project is Categorically Exempt (Class 4) from the California Environmental Quality Act
(CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature
and will have no permanent effects on the environment.
FISCAL IMPACT
None.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE
A courtesy notice concerning the event will be sent or hand delivered to businesses and apartment
residents within the project area by the applicant two weeks before the event.
RECOMMENDATION
It is recommended that the City Council approve Temporary Use Permit 03-18, subject to the
conditions contained in the attached proposed Resolution.

Applicant: A request for approval to hold the annual Poway Spring
Fest Street Fair along Midland Road on Sunday, April 27, 2003, from
10:00 a.m. to 4:00 p.m.
BACKGROUND
This is a request for a Temporary Use Permit to hold the annual Poway Spring Fest Street
Fair along Midland Road, on Sunday, April 27, 2003, from 10:00 a.m. to 4:00 p.m. The
event will include 200 booths, a kid's zone behind Wal-Mart and a stage for live
entertainment. Midland Road between Poway Road and Hilleary Place will be closed to
traffic from 5:00 a.m. to 7:00 p.m.
Pursuant to Section 17.26.030.A of the Poway Municipal Code, circuses, carnivals, rodeos,
parades, or similar outdoor entertainment or enterprises which do not exceed 5 calendar
days of operation in any calendar year may be approved with a Temporary Use Permit.
FINDINGS
The event is located along Midland Road between Poway Road and Hilleary Place.
Through-traffic on Midland Road will be detoured to streets west of Midland Road via
Poway Road, Community Road and Hilleary Place. Notice of the event will be provided to
adjacent residents and business owners affected by the road closure. The applicant is
aware of this requirement and will be providing the required notice in a timely manner.

The set up of the event will include 200 booths, a kid's zone to be located behind Wal-Mart
and a stage for live entertainment adjacent to the bus stop on the east side of Midland
Road. The booths will be set up on Midland Road and by the curb for Poway merchants to
sell their goods and services. An estimated 10,000 to 12,000 people are expected to
attend.
The applicant proposes to use the Stein Mart site, a portion of the Wal-Mart site and public
streets for parking. Arrangements have also been made with the United States Postal
Service to allow their vehicles access to the postal premises during designated times.
No problems were reported to the City of Poway Development Services Department
regarding the 2002 Poway Spring Fest Street Fair as well as the 2002 Poway Fall Fest
Street Fair held last November 10, 2002. The applicant coordinates with the City of Poway
Public Works and other public agencies for appropriate permitting. Specific conditions and
requirements have been established for the annual Poway Spring Fest Street Fair and are
in the attached Resolution (Attachment A).

RESOLUTION NO. P-
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 03-18
WHEREAS, Temporary Use Permit 03-18; Poway Chamber of Commerce,
Applicant, requests approval to hold the annual Poway Spring Fest Street Fair along
Midland Road on Sunday, April 27, 2003, from 10:00 a.m. to 4:00 p.m.
WHEREAS, on April 15, 2003, the City Council considered the above-referenced
item.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: The City Council finds that Temporary Use Permit 03-18 is Categorically
Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to
Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will
have no permanent effects on the environment.
Section 2: The proposed use is in accordance with the purposes and standards of
Section 17.26.030.A of the Poway Municipal Code.
Section 3: The City Council hereby approved Temporary Use Permit 03-18, the annual
Poway Spring Fest Street Fair, to be held along Midland Road between Poway Road
and Hilleary Place, on Sunday, April 27, 2003, from 10:00 a.m. to 4:00 p.m., subject to
the following conditions:
A. The event and related offsite parking shall be conducted as shown on the site
plan and application on file in the Development Services Department.
B. This permit is valid during the hours of 10:00 a.m. to 4:00 p.m. on Sunday, April
27, 2003, after which time the site shall be restored to its original condition.
C. The barricades can be placed at 5:00 a.m. and shall be removed by 7:00 p.m. on
Sunday, April 27, 2003.
D. Approval of this activity shall not excuse compliance with all other sections of the
Zoning Ordinance and all other applicable State, County, and City Ordinances
presently in effect.
E. The site shall be developed in accordance with the approved site plan dated and
on file in the Development Services Department, Planning Division, except as
may otherwise be provided herein, prior to commencement of the activity.
F. Prior to the event, the applicant shall comply with the following:

1. An alternative City bus route/stop plan for Midland Road shall be provided
and approved by the Community Services Department prior to the event.
G. The applicant shall comply with the following to the satisfaction of the Fire
Marshal:
1. Prior to and during the event, emergency vehicle access to any street,
building, fire hydrant, or fire sprinkler system connection shall not be
blocked.
2. Provide one 2A:10BC fire extinguisher at any booth where cooking food is
done.
3. All compressed gas cylinders must be secured from falling over.
4. A permit for any canopy that exceeds 400 square feet must be obtained
from the Fire Department.
H. At the conclusion of the event, the applicant shall comply with the following:
1. Public streets, off-street parking sites and areas within and adjoining to the
-- proposed area for the event, shall be cleared of debris, litter, temporary
signs, and all other evidence of the event shall be removed upon its
completion.
Section 4: This approval shall become null and void on April 27, 2003, at 7:00 p.m., at
which time the sites utilized shall have been restored to their original condition.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
State of California, at a regular meeting this 15th day of April 2003.
