Ord 758ORDINANCE NO. 758 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA, APPROVING SPECIFIC PLAN AMENDMENT 13 -003 TO THE SOUTH POWAY SPECIFIC PLAN TO CHANGE THE LAND USE DESIGNATION FROM LIGHT INDUSTRIAL TO LIGHT INDUSTRIAL - STORAGE ON A 2.19 -ACRE SITE LOCATED AT 13250 KIRKHAM WAY APN: 317- 270 -08 WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning) of the Poway Municipal Code provides the requirements for the preparation and adoption of Specific Plans in accordance with Title 7, Division 1, Chapter 3, Article 8 (Section 65450, et seq.) of the California Government Code (Article 8, Specific Plan); and WHEREAS, CWTN Associates LLC, ( "Applicant ") has submitted a request, Specific Plan Amendment (SPA) 13 -003, to change the land use designation on a previously developed, approximately 2.19 -acre, property located at 13250 Kirkham Way in the Poway Business Park, from Light Industrial (LI) to Light Industrial- Storage (LI -S); and WHEREAS, on December 3, 2013, the City Council held a duly advertised public hearing to receive testimony from the public, both for and against, relative to this application. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: Section 1: Pursuant to the California Environmental Quality Act (CEQA), the proposed project is Categorically Exempt as a Class 1 Categorical Exemption from the California Environmental Quality Act (CEQA) pursuant to Section 15301(e) of the 2013 CEQA Guidelines, in that the project involves an amendment to the South Poway Specific Plan (SPSP) to change the land use designation from Light Industrial (LI) to Light Industrial- Storage (LI -S) and the approval of a Conditional Use Permit (CUP) for an existing use on a developed site that includes a contractor's office with outdoor storage and will result in any expansion of the use. Specifically, the project will not result in any increase in floor area space. Additionally, (1) there is no reasonable possibility that the project will have a significant effect on the environment due to unusual circumstances; (2) the proposed project will not result in damage to scenic resources; (3) the proposed project is not to be used for a project located on a hazardous waste site; and (4) the proposed project will not cause a substantial adverse change in the significance of a historical resource. Section 2: The City Council finds that the proposed amendment of the South Poway Specific Plan (SPSP) to change the land use designation on a developed lot, approximately 2.19 -acre, property located at 13250 Kirkham Way in the Poway Business Park, from Light Industrial (LI) to Light Industrial- Storage (LI -S) is consistent with and will still promote the systematic execution of the General Plan, in that use of the Property will still be subject to applicable General Plan goals, policies and the Light Industrial- Storage land use designation of the SPSP. Ordinance No. 758 Page 2 Section 3: The City Council hereby approves Specific Plan Amendment 13 -003 changing the land use designation from Light Industrial (LI) to Light Industrial- Storage (LI -S) on the property shown in Exhibit A attached to this Ordinance. EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30) days after the date of its passage; and before the expiration of fifteen (15) days after its passage, it shall be published once with the names and members voting for and against the same in the Poway News Chieftain, a newspaper of general circulation published in the City of Poway. Introduced and first read at a regular meeting of the City Council of the City of Poway held this 3rd day of December 2013, and thereafter PASSED AND ADOPTED at a regular meeting of said City Council held the 7th day of January 2014.
