AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA,
AMENDING CHAPTER 2.18 OF THE POWAY MUNICIPAL CODE
CONCERNING DECORUM AT CITY COUNCIL MEETINGS
WHEREAS, it is the duty of the City Council to review and amend City
ordinances from time to time to assure that such ordinances conform to statutory and
constitutional requirements; and
WHEREAS, federal law has been interpreted by the federal courts to require that
disruption of a city meeting is required before a speaker may be declared out of order,
barred from the audience, and prosecuted for inappropriate conduct; and
WHEREAS, Section 2.18.180C may be interpreted to authorize removal of a
speaker from a public meeting for conduct which is not disruptive.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS:
SECTION 1: Poway Municipal Code section 2.18.180C is hereby amended to
read as follows:
Any person who does not comply with the above rules and who disrupts the
orderly course of the meeting is guilty of an infraction and may be called out of order by
the Mayor, removed from the podium, or, if necessary to maintain order, barred from
further audience before that session of the Council.
SECTION 2: This Ordinance shall be codified.
EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30)
days after the date of its passage; and before the expiration of fifteen (15) days after its
passage, it shall be published once with the names of members voting for and against
the same in the Poway News Chieftain, a newspaper of general circulation published in
the City of Poway.

Poway held the 10th day of July, 2001, and thereafter PASSED AND ADOPTED at a
regular meeting of said City Council held the 31st day of July, 2001, by the following mil
