Res 97-019RESOLUTION NO. 97-019 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA REGARDING ANNUAL DESIGNATION OF INAPPROPRIATE AREAS FOR SECOND DWELLING UNITS IN SINGLE FAMILY RESIDENTIAL ZONES WHEREAS, the City Council of the City of Poway adopted the Poway Comprehensive Plan in November 1991, and WHEREAS, the City has established goals, policies, and strategies to implement the Comprehensive General Plan; and WHEREAS, the successful implementation of the goals, policies, and strategies is dependent on planned capacities of the infrastructure system, i.e., transportation, wastewater, water, and drainage based on planned land use densities and intensities; and WHEREAS, it is the desire of the City to ensure that traffic does not exceed the capacity of the street system; and WHEREAS, it is necessary for the public health, safety and welfare to ensure that the capacity of public utility systems is not exceeded; and WHEREAS, the wastewater system has deficiencies in treatment capacity, transportation facilities, collection, and pumping facilities; and WHEREAS, the construction of second dwelling units on single family residential zones will create more traffic and wastewater volumes. NOW THEREFORE, BE IT RESOLVED THAT the City Council determines that second dwelling units will not be permitted in areas of the City where sewer, water, or other utility or public service systems are inadequate for current demand or which will be inadequate for demand at build-out of the community in accordance with the Comprehensive Plan; and BE IT FURTHER RESOLVED THAT the City Council determines that second dwelling units will not be permitted in areas of the City which are served by roadways where the level of service is "D" or lower or where the level of service will be "D" or lower at build-out; and BE IT FURTHER RESOLVED THAT the areas of the City in which second dwelling units will not be permitted shall be determined each year by adoption of maps depicting areas where service or roadway deficiencies exist. The maps where service and roadway deficiencies exist are attached as Exhibits A and B.
