Res 97-036 RESOLUTION NO. 97-036 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY CREATING AN ALTERNATIVE METHOD FOR COLLECTING SEWER CONNECTION FEES FOR HIGH VOLUME SEWER USERS WHEREAS, Ordinance No. 473 has been adopted by the City Council authorizing an alternative method for collecting sewer connection fees for high volume sewer users. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Poway does hereby resolve as follows: Section 1: Alternative Method for Collecting Sewer Connection Fees for High Volume Sewer Users The City of Poway has established a new class of sewer users which is called "high volume sewer users." An applicant would qualify as a high volume sewer user if they generated more than 25,000 gallons per day ADF (Average Dally Flow). The applicant is required to pay a minimum sewer connection fee calculated at the minimum current rate of one EDU per 6,000 square feet. This capacity would remain with the property and would be collected at building permit issuance. Once an applicant is declared a "high volume sewer user" they are eligible to lease their required sewer capacity. The lease payments are collected on their bimonthly sewer bill based on the average daily flow calculated for the bi-month period. The bimonthly lease rates are based on financing the connection fees at an indexed interest over a 30-year period. The interest rate is calculated based on 12 month London Interbank Offered Rate (LIBOR) and adjusted annually. Staff will calculate the base rate and provide it to the applicant before payment of connection fees. The base rate will be documented and then applied to the sewer billing. The sewer discharge for a two month period is converted to an average daily flow and then multiplied by the prevailing factors to calculate the bimonthly lease rate for sewage capacity. The rate will be adjusted annually. The applicant has the option of either paying all of their sewer connection fees at building permit issuance or participating in the lease rate. Participating in the lease program provides sewer capacity as needed; however, the property owner obtains no ownership in sewer capacity and could not be transferred in the future other than the minimum purchased capacity. H. A high volume user applicant is required to construct a sewer discharge metering facility upon which their bimonthly sewer rate and connection fee lease rate is based.
