Ord 545ORDINANCE NO. 545 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA, AMENDING THE DEVELOPMENT SERVICES DEPARTMENT BUILDING DIVISION FEE SCHEDULE TO REDUCE BY TWENTY-FIVE PERCENT THE PERMIT FEE FOR SOLAR SYSTEMS AND RESCINDING RESOLUTION NO. 93-049 WHEREAS, the City of Poway provides permit services to citizens of Poway; and WHEREAS, California Government Code Section 66016, et. seq., establishes procedures for the adoption of fees for services provided by local government; and WHEREAS, the processing of such permits will require staff time to investigate the circumstances surrounding the application; and WHEREAS, permit fees for building services were last amended by the City Council on April 6, 1993, by Resolution No. 93-049; and WHEREAS, the City Council finds that it is in the best interest of the community to encourage the use of solar energy systems to reduce the demand for electricity; and WHEREAS, to provide an incentive for the use of solar energy systems, the City Council finds it appropriate to reduce by twenty-five percent, the permit fee that is collected by the Development Services Department Building Division solar systems. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: Section 1: The City Council hereby finds that this amendment is Statutorily Exempt from the provisions of the California Environmental Quality Act pursuant to Section 15273 (a) (1) because it is a reduction in a permit fee that is otherwise necessary to meet operating expenses. Section 2: The City Council hereby adopts the Development Services Department Building Division Fee Schedule as set forth in the attached Exhibit A and it shall become effective on December 1,2001. Section 3: Resolution No. 93-049 is hereby rescinded, effective December 1, 2001. Ordinance No. 545 Page 2 EFFECTIVE DATE: This ordinance shall take effect and be in force thirty (30) days after the date of this passage; and before the expiration of fifteen (15) days after its passage, it shall be published once with the names and members voting for and against the same in the Poway News Chieftain, a newspaper of general circulation published in the City of Poway. Said plan review fee shall be 65% of the building permit fee as established after disabled access inspection fees and energy code inspection fees have been added to the building permit fee. 9. When Chapter 12 is applicable (see Section 103), permit fees for fuel-gas piping shall be as follows: a. For each gas-piping system of one to four outlets b.
