a RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE OLD POWAY SPECIFIC PLAN, SP 88-01 TO UPDATE THE LIST OF
COMMERCIAL USES ALLOWED IN CONFORMANCE WITH CHANGES TO THE
USES ALLOWED IN THE COMMERCIAL GENERAL(CC) ZONE
(SPA 88-01A)
WHEREAS, Section 65450 et seq of the California Government Code provides for
the adoption and modification of specific plans for the systematic implementation of the
general plan for all or part of the area covered by the general plan; and
WHEREAS, Chapter 17.47 of the Poway Municipal Code establishes procedures
for the adoption and modification of specific plans within the City of Poway; and
WHEREAS, on July 26, 1988 the City Council adopted Part One of the Old Poway
Specific Plan and on January 30, 1990 amended Part One and adopted part Two of that
plan; and
WHEREAS, there have been subsequent amendments to the Poway Municipal
Code which change the uses permitted in the Commercial General zone; and
WHEREAS, it is appropriate to amend the list of uses permitted in the Commercial
General zone within the Old Poway Specific Plan area to reflect those amendments; and
WHEREAS, it has been determined that the proposed amendments to the Old
Poway Specific Plan, SPA 88-01A, are statutorily exempt from the California
Environmental Quality Act; and
WHEREAS, in accordance with the requirements of the California Government
Code, the City Council held a properly noticed public hearing on August 26, 1997 to take
public input and consider the proposed amendment SPA 88-01A.
NOW, THEREFORE, the City Council does hereby resolve that Part Two of the Old
Poway Specific Plan is amended as follows:
PLANNING AND DESIGN PROPOSALS, SPECIAL REQUIREMENTS
The uses permitted for commercially zoned properties located within the CG zone in the
Old Poway Specific Plan area shall be the same as for the Commercial General (CC) zone
of the Zoning Development Code with the following exceptions.

The following uses shall not be permitted:
1. Appliance stores and repair
2. Athletic and Health Club
3. Automobile and or truck services (including, but not limited to, body repair, painting,
and car washes)
4. Boat and recreational vehicle sales and services
5. Fast food restaurants with drive-in or drive-through
6. Equipment rental yards including, but not limited to, trucks, trailers, hitches and
services thereof
7. Supermarkets
8. Gasoline dispensing and/or automotive service stations
9. Department stores, discount department stores and membership department stores
10. Motorcycle sales and services including motorized bicycles
11. Nurseries and garden supply stores (except small-scale, retail, specialty stores
where all equipment and supplies are kept within an enclosed area)
12. Sign painting shops
13. Tire sales and services
14. Vehicle towing companies and storage lots
15. Convalescent homes and hospitals
The following additional uses shall be permitted:
Small hotels, bed and breakfast establishments, and boarding houses
Farmer's markets
Civic buildings
The following uses shall be permitted with approval of a Conditional Use Permit
Residential units within a commercial project
APPROVED and ADOPTED by the City Council of the City of Poway, State of
