Res 97-092RESOLUTION NO. 97-09? A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA ESTABLISHING WATER RATES FOR FISCAL YEAR 1997-1998 AND RESCINDING RESOLUTION NO. 96-074 WHEREAS, the City of Poway provides water service to citizens of Poway; and WHEREAS, the City of Poway conducted a Water and Wastewater Rate Study which was completed in October 1997. The study reviewed current water rate structures from the standpoint of customer equity, consistency with City policy objectives, and cost of service. Based upon that review, changes to the City's water rate structure were recommended; and WHEREAS, the City currently has a fixed bimonthly service charge (capacity charge) based on the size of the water meter. Water system capacity costs are generally allocated to customers based on the hydraulic capacity associated with meter size. The City's current service charges do not fully reflect the relative capacity differences of various meter sizes. The study recommends a rate structure for the fixed bimonthly service charge based upon the hydraulic capacity of the meter size; and WHEREAS, the City currently generates 12 percent of water rate revenues from the fixed service charge. Service charges commonly recover 20 to 30 percent of water rate revenues. The study recommends slightly increasing the charges allocated to fixed costs so that the fixed service charge generates 13.8 percent of water rate revenues; and WHEREAS, the fixed bimonthly service charge (capacity charge) adopted herein shall be imposed as a condition of service by the City to the customer. Any customer may avoid payment of the fee or charge by disconnecting from the facilities of the City. This fee or charge is not imposed upon real property or upon a person as an incident of property ownership; and WHEREAS, the City has a basic water use charge (commodity charge). The study recommends retaining the current basic water use rate structure; and WHEREAS, the basic water use charge adopted herein shall be imposed on the basis of the amount of water used or consumed by the customer. The fee or charge is not imposed upon real property or upon a person as an incident of property ownership. A customer may reduce or avoid the fee by reducing or discontinuing use; and Resolution No. 97-092 Page 2 WHEREAS, it is necessary to retain the pumping charges for established Service Areas; and WHEREAS, it is necessary to retain a Raw Water Rate and other charges; and WHEREAS, all fees or charges adopted herein were not calculated or developed on the basis of any parcel map, including an assessor's parcel map. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway: Section 1. That the water rate schedule is hereby established as follows for all water billed on the first full billing cycle after January 1, 1998: Service Type Charge Per Unit (100 cubic feet) The basic water rate for all classes of service including agriculture and agriculture/domestic shall equal (per unit) $1.665 Water Customers within the areas specified below shall pay a bimonthly pumping charge for service from a water reservoir: Improvement District No. 1 $0.200 Improvement District No. 4 0.055 Orchard A-73, Silver Saddle 0.082 Donart 0.150 Service Area VI 0.130 Assessment District 79-1 0.100 Community Pump Station 0.150 Welton 0.150 Resolution No. 97- 092 Page 3 I Service Type I Charge Basic Water Service Charges All water customers shall pay a bimonthly basic water service charge for water service based upon meter size as follows: 5/8 inch $15.31 3/4 Inch 15.31 1 inch 28.47 I 1/2 inch 50.41 2 inch 76.73 3 inch 146.94 4 inch 225.91 6 inch 533.05 8 inch 708.56 The basic raw water rate for raw water usage Actual cost of raw water from SDCWA (currently $444 per acre foot) plus a surcharge of $28.30 Restoration of Service $20 during normal working hours; $45.00 for weekends or after or before normal working hours; $55.00 for holidays Delinquency 10 percent of unpaid balance or $25.00, whichever is less Returned Check $10.00 Agricultural Rebate for Qualified Agricultural Users $0.259 Resolution No. 97- 092 Page 4 ~ That the setting of such charges and rates is categorically exempt from the requirements of CEQA, pursuant to Sections 1080(b)(4) and (b)(8)(1)& (2) and Section 21060.3 of the Public Resources Code, and Title 14 of the California Code of Regulations, Section 15269(c) and 15273(a)(1) & (2) and 15307. Section 3. That Resolution No. 96-074 is hereby rescinded.
