Res 97-093RESOLUTION NO. 97- 093 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA AMENDING THE SCHEDULE OF SEWER SERVICE CHARGES AND ESTABLISHING SEWER SERVICE CHARGES FOR FISCAL YEAR 1997-1998 AND RESCINDING RESOLUTION NO. 96-075 WHEREAS, the City of Poway provides sewer service to citizens of Poway; and WHEREAS, the City of Poway conducted a Water and Wastewater Rate Study which was completed in October 1997. The study reviewed current sewer rate structures from the standpoint of customer equity, consistency with City policy objectives, and cost of service. Based upon that review, changes to the City's water rate structure were recommended; and WHEREAS, the City currently has an equivalent service or dwelling unit (EDU) based sewer rate structure with the same fiat rate charge per EDU. The structure does not account for actual water consumption per EDU which varies significantly. The study recommends that the rate structure be changed to a user charge system based on water consumption and which takes into account both quantity and quality of a customer's sewage; and WHEREAS, the revised sewer rate structure would include several components; and WHEREAS, a bimonthly service charge be established to recover all costs associated with customer service and a portion of the fixed costs associated with maintaining the capacity of the City's sewer system; and WHEREAS, the fixed bimonthly service charge (capacity charge) adopted herein shall be imposed as a condition of service by the City to the customer. Any customer may avoid payment of the fee or charge by disconnecting from the facilities of the City. This fee or charge is not imposed upon real property or upon a person as an incident of property ownership; and WHEREAS, a seven-tier single-family residential sewer commodity charge is established, which includes the bimonthly sewer service charge for single family customers. Single-family residential customers are assigned a commodity charge tier each year based on 85 percent of their water use during the prior year's lowest usage cycle in winter months; and WHEREAS, a variable sewer commodity rate is established for multi-family and mobile home customers. The variable commodity charge is based on 85 percent of the water through the water meter if a separate landscape meter exists. If a separate landscape meter does not exist, the variable commodity charge is based on 75 percent of the water through the water meter; and Resolution No. 97- 093 Page 2 WHEREAS, a variable sewer commodity rate is established for multi-family and mobile home customers. The variable commodity charge is based on 85 percent of the water through the water meter if a separate landscape meter exists. If a separate landscape meter does not exist, the variable commodity charge is based on 75 percent of the water through the water meter; and WHEREAS, a variable sewer commodity rate is established for all non-residential customers based upon customer class and estimated sewage strength of the user. The variable commodity charge is based on 90 percent of the water through the meter for the five categories of commercial users. Institutional (schools and churches) variable commodity charge is based on 75 percent of the water through the meter; and WHEREAS, the variable sewer commodity charge adopted herein shall be imposed on the basis of the established percentages of amount of water through the water meter. The fee or charge is not imposed upon real property or upon a person as an incident of property ownership. A customer may reduce or avoid the fee by reducing or discontinuing use; and WHEREAS, it is necessary to retain the pumping charges for established service areas; and WHEREAS, it is necessary to retain delinquency fee and other noted fees in FY 97-98. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway: SP_.cliox~. That a schedule of bimonthly sewer service charges is hereby established for all sewer services billed on the first full billing cycle after January 1, 1998. Schedule of Bimonthly Sewer Service Charges All sewer customers shall pay a bimonthly basic sewer service charge for sewer service based upon meter size as follows: Single Family* $ 7.03 5/8-inch and 3/4-inch 8.33 l-inch 10.93 1-1/2-inch 17.42 2-inch 25.22 3-inch 46.01 4-inch 69.39 6-inch 160.33 8-inch 212.30 *A special class has been established for sewer bimonthly service charge for all single family residential users based on a 5/8-inch meter. All other classes of residential and commercial/industrial bimonthly service charges are based on actual water meter size beginning with the combined 5/8-inch and 3/4-inch class. All single-family residential customers shall pay a bimonthly seven- tier fiat commodity charge as follows: Single-Family Residential Customers Tier Water Use Tier 1 (0-5 HCF) $ 19.31 Tier 2 (6-12 HCF) 31.58 Tier 3 (13-19 HCF) 43.86 Tier 4 (20-26 HCF) 47.95 Tier 5 (27-33 HCF) 54.09 Tier 6 (34-40 HCF) 60.23 Tier 7 (41+ HCF) 66.36 These rates include the $7.03 bimonthly service charge. Single- family customers are assigned a commodity charge tier each year based on 85% of their water use during their lowest usage cycle in winter months. Resolution No. 97-093 Page 4 Charge Per Unit Description (100 cubic feet) All multi-family, mobile home, nonresidential and institutional customers shall pay a bimonthly variable commodity rate on estimated sewer flow as follows: Multi-Family and Mobile Home Estimated sewer flow based on 85% of customer's bimonthly water usage (75% if a separate landscape meter does not exist). $2.05 Nonresidential Customers Estimated sewer flow based on 90% of customer's bimonthly water usage: General Commercial $2.05 Medium Low 2.37 Medium 3.01 High 4.72 Light Industry 2.15 Estimated sewer flow based on 75% of customer's bimonthly water usage: Church $2.05 Schools 2.05 Note: See Exhibit I for listing of business types in each category. All service connections whose wastewater is serviced by wastewater pump stations (including the Rancho Bernardo Pump Station) will be charged $1.36/month surcharge for each pump station utilized. Upon change of ownership, sewer charges will be prorated on a 60-day billing period basis between old and new customer. A delinquency fee of 10 percent of the unpaid balance or $25.00, whichever is less, shall be charged on all accounts that remain unpaid for more than 30 days.
