Res 97-098RESOLUTION NO. 97- 0 9 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY FINDING THAT HOUSING FUND MONIES USED OUTSIDE THE PROJECT AREA FOR PLANNING AND ADMINISTRATION COSTS IN FY 1994-95 WERE OF BENEFIT TO THE PROJECT AREA WHEREAS, Section 33334.2 of the Califomia Health and Safety Code requires that not less than 20 percent of taxes which are allocated to the Redevelopment Agency be used for the purpose of increasing, improving, and preserving the community's supply of housing available at an affordable housing cost to households with low and moderate incomes; and WItEREAS, the AB 1290 Redevelopment and Housing Implementation Plan, approved by the Redevelopment Agency on November 29, 1994, outFmes a balance of programs and projects that will increase, improve and preserve the supply of housing available at an affordable housing cost to households with low and moderate incomes; and WHEREAS, Section 33334.3(e) provides that the Redevelopment Agency may charge its Housing Fund for planning and administrative costs which directly relate to qualified low- and moderate-income housing projects and programs; and WHEREAS, Section 33334.3(d) of the California Health and Safety Code provides that the Redevelopment Agency must determine annually that the planning and administrative expenses paid by the Housing Fund are necessary for the production, improvement or preservation of low- and moderate-income housing; and, WHEREAS, the Redevelopment Agency may expend monies from its Low- and Moderate- Income Housing Fund for affordable housing projects and programs outside the Project Area upon a finding by the Legislative Body that said expenditures are of benefit to the Project Area; and WHEREAS, in 1993 the Redevelopment Agency approved a detailed method for calculating the actual cost of planning and administering the Agency's affordable housing projects and programs; and WHEREAS, Redevelopment Agency staff completed a thorough analysis to calculate the actual costs directly associated with the planning and administration of affordable housing projects and programs that were charged to the Housing Ftmd during FY 1994-95 and reviewed this analysis in a detailed report considered by the Agency Board on November 14, 1995. Resolution No. 97-0 9 8 Page 2 NOW, THEREFORE, the City Council of the City of Poway does resolve the following: Section 1: The expenditure of monies from the Redevelopment Agency's Low- and Moderate-Income Housing Fund in FY 1994-95 to cover costs associated with planning and administering affordable housing projects and programs was necessary for the Agency to meet its obligation to increase, improve, and preserve the supply of affordable housing available within the City of Poway. Section 2: The expenditure of $500,617 from the Redevelopment Agency's Low- and Moderate-Income Housing Fund in FY 1994-95 was necessary to cover actual costs incurred in by the City and Agency in their efforts to increase, improve and preserve the community's supply of housing available at an affordable housing cost to households with low- and moderate-incomes. Section 3: The amount of $500,617 represents the actual cost of planning for and administering affordable housing projects and programs during FY 1994-95, and this cost is not disproportional to the Housing Fund monies expended to produce, improve or preserve said affordable housing. Section 4: Housing Fund monies that were expended during FY 1994-95 for planning and administering affordable housing projects and programs outside the PaguaY Redevelopment Project Area are of benefit to said Project Area.
