A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
REQUESTING THE BOARD OF SUPERVISORS TO CALL AN
ELECTION IN ZONE F OF
COUNTY SERVICE AREA 135
WHEREAS, on December 6, 1994, the Board of Supervisors of the County of San
Diego formed County Service Area 135-Regional 800 MHZ Radio System and, with the
consent of this City Council, included the City of Poway within County Service Area 135;
and
WHEREAS, with the consent of this City Council, the Board of Supervisors, on
December 6, 1994, established Zone F City of Poway 800 MHZ consisting of all territory
within the boundaries of this City; and
WHEREAS, the Board of Supervisors pursuant to Government Code section
25210.77a, levied a county service area charge within the boundaries of County Service
Area 135 to pay for the "backbone" of the Regional 800 MHZ Radio System; and
WHEREAS, upon the request of this Council, the Board of Supervisors levied a
county service area charge pursuant to Government Code section 25210.77a within
Zone F City of Poway, to pay for City user equipment and other expenses related to the
800 MHZ Regional Communication System; and
WHEREAS, in November 1996, the voters of the State of California adopted
Proposition 218 which added Articles 13C and 13D to the State Constitution relating to
special and general taxes, property related fees and assessments; and
WHEREAS, due to the previsions of Proposition 218, the Board of Supervisors
ceased to levy both the county service area backbone charge and the zone charge as of
July 1, 1997; and
WHEREAS, it is the desire of the Board of Supervisors and this Council to allow
the voters to decide to replace these previously levied county service area charges with
special taxes in the same amount; and
WHEREAS, the Board of Supervisors is willing to call an election within Zone F
City of Poway for the voters to determine whether a special tax shall be adopted to replace
the county service area zone charge if this Council so requests:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Board of Supervisors is requested to call an election within the
boundaries of County Service Area 135 Zone F City of Poway for purposes of placing
before the voters of the zone the question whether a special tax shall be adopted
replacing the previous county service area charge levied within the zone with a special tax
to be used exclusively for local expenses incurred in the 800 MHZ Regional
Communication System.

SECTION 2. The election shall be held on a date determined by the Board of
Supervisors and at the same time as the election on the county service area backbone
charge.
PASSED, ADOPTED, AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting thereof this 18th day of November, 1997.
