A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
ORDERING THE EXPANSION OF POWAY
LANDSCAPE MAINTENANCE DISTRICT 86-1
WITH THE ANNEXATION OF PORTIONS OF
APNs 277-170-01-00, 277-170-04-00, AND 277-171-26-O0
WITH WRITTEN CONSENT OF PROPERTY OWNER
WHEREAS, the City Council of the City of Poway desires to expand Poway
Landscape Maintenance District 86-1 for the purposes of maintaining, servicing, and
operating said district as shown in Exhibit "A" pursuant to the Landscape and Lighting
Act of 1972; and
WHEREAS, the record owner of all the real property within said expansion area
has given written consent to the formation and annexation into Poway Landscape
Maintenance District 86-1 pursuant to California Streets and Highway Code, Section
22608.1; and
WHEREAS, the public interest and convenience require the maintenance,
service, and operation of public landscape facilities within said territory.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Poway does hereby resolve as follows:
The foregoing recitals are true and correct, and the City Council so finds
and determines.
All of that certain territory shown in Exhibit "A," attached hereto, is hereby
added by annexation into Poway Landscape Maintenance District 86-1.
PASSED, ADOPTED, and APPROVED by the City Council of the City of Poway,
California, at a regular meeting this 24th day of March, 1998.

CONSENT TO ANNEXATION
FOR THE INCLUSION OF PROPERTIES INTO
CITY OF POWAY LANDSCAPE MAINTENANCE DISTRICT 86-1
AND CITY OF POWAY CITY LIGHTING DISTRICT, ZONES A AND C
WHEREAS, the undersigned constitute(s) 100 percem ownership [or has legal signature authority representing
100 percent ownership] of the property ~own in Exhibit A, attached hereto, and generally described as portions of
County Assessor Parcel Nos. 277-170-01-00, 277-170-04-00, and 277-171-26, as they relate to Phase II, Unit I of
TM 89-13R, consisting of 203.22 acre; and
WHEREAS, the legal description of the Golf Course property is as follows:
Parcel 3 of Parcel Map No. 17989, in the City of Poway, County of San Diego, State
of California, filed in the office of the County Recorder of San Diego County,
February 25, 1998 as File No. 1998-0099090 of Official Records; and
WHEREAS, any subsequem parcels created by any fature subdivision of said parcels shall become a part of
thig annexation; and
WHEREAS, the aforementioned property is proposed to be developed by subdivision and will receive special
benefit from City [District]-maimained street lighfin! and landscaping; and
WHEREAS, the undersigned owner(s) do hereby consem to annexation imo Poway Landscape Maintenance
District 86-1 and the City of Poway City Lighting District, Zones A and C, pursuant to the California Streets and
Highways Code Section 22608.1; and
WHEREAS, the undersigned owner(s) consem to assessments levied under the assessment formulas as written
within the yearly LMD 86-1 Engineer's Reports, and hereby acknowledges receipt of the lzndscaping and lighting
benefits to said property.
PURSUANT to Section 22608.2 of the Stree~ and Highways Code of the State of California, these properties
will be included within the required Engineer's Report. The siLming of thi~ consent to annexation precludes any and
all notice and hearing requirements for the first year's Report.
