Ord 558ORDINANCE NO. 558 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES (ZC 02-01) WHEREAS, the City Council of the City of Poway has approved a General Plan Amendment GPA 02-01, amending the land use designation of 53 parcels, or portions thereof, APN: 275-240-67, 277-020-29,277-080-24,277-140-09, 277-140-11,277-140- 13, 277-140-14, 278-210-24, 278-210-31, 278-280-34, 278-280-43, 278-280-44, 278- 320-10, 278-461-20, 314-033-16, 314-033-17, 314-650-01, 314-650-37, 314-650-45, 321-090-25, 321-090-26, 321-090-27, 321-090-28, 321-090-29, 321-090-30, 321-090- 31, 321-100-01, 321-100-08, 321-110-02, 321-110-24, 321-111-14, 321-111-15, 321- 111-16, 321-111-19, 321-111-20, 321-160-13, 321-161-01, 321-220-10, 321-260-02, 321-260-03, 321-260-04, 321-260-05, 321-270-48, 321-270-55, 321-270-60, 321-270- 66, 322-010-39, 322-010-40, 322-010-41, 322-010-42, 322-010-49, 322-041-11, 323- 290-12, 323-501-06; and WHEREAS, the City Council finds that the zoning classification of the property should also be changed to maintain consistency with the General Plan as required by Section 65860 of the California Government Code and the California Environmental Quality Act to consider this zone reclassification; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: Section 1: The City Council has considered the Environmental Initial Study (ELS) and Negative Declaration (ND), for General Plan Amendment 02-01A and public comments received on the ElS and ND. The subject ElS and ND documentation are fully incorporated herein by this reference. The City Council finds, on the basis of the whole record before it, that there is no substantial evidence the project will have a significant impact on the environment. The City Council hereby approves the Negative Declaration. Assessor's Parcel Number 321-161-01, previously referenced, was recently changed by the County Assessor's Office to 321-161-07 and the proposed redesignation in land use to OS-RM shall be applied to the revised Assessor's Parcel Number. EFFECTIVE DATE: This ordinance shall take effect and be in force thirty (30) days after the date of passage; and before the expiration of fifteen (15) days after its passage, it shall be published once with the names and members voting for and sgainst the same in the Poway News Chieftain, a newspaper of general circulation published in the City of Poway.
