A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA, ADOPTING A POLICY REGARDING THE
SUSPENSION OF HANDICAP PARKING PENALTIES
WHEREAS, Section 42001.5 of the Vehicle Code provides that the
imposition of the fine for a violation of Section 22507.8 (parking spaces for
the disabled) may be suspended if the person convicted possessed at the
time of the offense, but failed to display, a valid distinguishing license plate
or placard issued pursuant to Section 22511.5; and
WHEREAS, the City Council wishes to recover the cost of issuing
and administrating the properly issued citations without punishing those
violators who were in possession of valid placards at the time of violation
but who failed to display them as required by Vehicle Code Section
22507.8.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Poway hereby establishes that the administrative reviewer shall
suspend the $330 penalty for violation of Section 22507.8 if the violator
had at the time of the offense, but failed to display, a valid placard, on
condition that the violator pay a $20 administrative fee.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the $20
fee shall be collected by the City of Poway, the $5 surcharge shall be
forwarded to the County of San Diego from said fee, and the balance shall
be applied to administrative costs incurred in processing the citation.
APPROVED AND ADOPTED by the City Council of the City of
Poway, State of California, this 4th day of August, 1998.
