A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE LAND USE ELEMENT OF
THE GENERAL PLAN OF THE CITY OF POWAY
GENERAL PLAN (GPA 98-02A)
WHEREAS, the City Council of the City of Poway recognizes that the need may
arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code describes
the procedures for amending General Plans; and
WHEREAS, M. Grant Construction Inc. has initiated a General Plan Amendment,
GPA 98-02A, for a modification of land use for an approximate 1.36 gross acre site (APN
317-130-68) located on the southeast corner of Community Road and Hilleary Place, and;
WHEREAS, the application proposes a change in land use from Town Center (TC)
to Commercial General (CG); and
WHEREAS, the City of Poway held a propedy noticed public hearing in accordance
with the California Government code and the California Environmental Quality Act to
consider that request; and
WHEREAS, the City Council finds that proposed General Plan Amendment 98-02A
will not have significant adverse impact on the environment and hereby issues a Negative
Declaration and;
WHEREAS, the City Council further finds that the proposed General Plan
amendment would result in a land use designation that is compatible and consistent with
the existing commercial structures and businesses and with the adjoining Town Center
land uses to the south.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby amend
the City of Poway General Plan Land Use Map of the Land Use Element for the above
described property from Town Center (TC) to Commercial General (CG).
APPROVED and ADOPTED by the City Council of the City of Poway, State of
