Res 98-098RESOLUTION NO. 98-098 a RESOLUTION OF THE CITY COUNCIL Of THE CITY OF POWAY, CALIFORNIA, ORDERING THE VACATION OF WATER EASEMENTS LOCATED IN LOTS 23, "A" AND "F", AND LOTS 26, 32, 33, 36, "D" AND "E" OF MAP NO. 13435, RECORDED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO COUNTY ON JUNE 26, 1997 (Vacation No. 98-03) WHEREAS, the City Council of the City of Poway desires to summarily vacate certain water easements in accordance with the procedures provided in Chapter 4, Part 3, Division 9 of the Streets and Highways Code of the State of California, commencing at Section 8330; and WHEREAS, water easements described by the attached documents were dedicated as follows: (1) Legal description titled Exhibit "A" and plat entitled Exhibit "B" were dedicated to the Poway Municipal Water District by an easement recorded April 8, 1976, as File/Page 76-103016 in Official Records; and, (2) legal description titled Exhibit "C" and plat entitled Exhibit "D" were dedicated to the Poway Municipal Water District by an easement recorded January 17, 1961, as File/Page No. 8720, in Official Records. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: 1. This summary vacation is made under the provisions of Chapter 4, Part 3, Division 9 of the Streets and Highways Code of the State of California. 2. The City Council hereby finds that the herein described water easements are unnecessary due to development of the area. 3. The City Council hereby declares that the following water easements are vacated: See attached legal descriptions titled Exhibit "A" and Exhibit "C", and plats entitled Exhibit "B" and Exhibit "D". The City Clerk of the City of Poway is hereby directed to cause a certified copy of this resolution to be recorded in the Office of the County Recorder of San Diego County in accordance with the provisions of Section 8336 of the Streets and Highways Code.
