RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
FINDING THAT THE EXPENDITURE OF REDEVELOPMENT AGENCY HOUSING FUNDS
TO PURSUE THE DEVELOPMENT OF AFFORDABLE HOUSING
OUTSIDE THE PROJECT AREA BENEFITS THE REDEVELOPMENT PROJECT
WHEREAS, the Poway Redevelopment Agency (the "Agency") is a community
redevelopment agency organized and existing under the Community Redevelopment Law,
Health and Safety Code Section 33000, et seq; and
WHEREAS, not less than 20 pement of all tax increment allocated to the Agency must
be placed in a fund (the "Housing Fund") and used for the purpose of increasing, improving and
preserving the community's supply of Iow- and moderate-income housing available, at
affordable housing cost, to persons and families of very-low, Iow and moderate incomes; and
WHEREAS, Section 33334.2(g) of the Califomia Health and Safety Code provides that
the Agency may expend Housing Fund monies outside the Paguay Redevelopment Project
Area (the "Project Area") upon resolution of the Agency and the City Council that the use will
be of benefit to the Redevelopment Project; and
WHEREAS, the Agency is currently pursuing the potential development of affordable
senior housing on the Gateway site, which is located outside the Project Area; and
WHEREAS, in order to carry out and implement the Redevelopment Plan (the "Plan")
for the Project Area and the affordable housing requirements thereof, the Agency desires to
continue to contract for services provided by David Paul Rosen & Associates ("DRA") to assist
with evaluating, negotiating, and structuring the development of affordable senior housing on
the Gateway site to insure maximum leverage of the Housing Fund; and
WHEREAS, the development of affordable senior housing on the Gateway site, which
is located within one mile of the Redevelopment Project Area boundary, would benefit the
Project Area by providing affordable housing and supportive services for elderly persons who
currently live within the Project Area; and
WHEREAS, the Gateway development would provide affordable housing and in many
cases significantly reduce housing expenses for its eldedy residents, thereby allowing for
greater discretionary income of said residents which could be expended in businesses located
within the adjacent Project Area; and
WHEREAS, the Gateway affordable housing development is consistent with the AB
1290 Redevelopment and Housing Implementation Plan, approved by the Agency on
November 29, 1994, and updated on November 4, 1997; the Comprehensive Affordable
Housing Strategy, approved by the Agency on April 16, 1996; the terms of the Judgment
entered in the Case of Smith v. All Persons on January 26, 1995; and the General Plan of the
City of Poway.

NOW, THEREFORE, the City Council of the City of Poway does resolve as follows:
Section 1. The City Council hereby finds that the foregoing statements are true and
correct, and incorporated herein.
Section 2. The City Council hereby finds that the expenditure of monies from the
Housing Fund for consultant services provided by DP, A, to evaluate the feasibility and assist
in negotiations and structuring of affordable senior housing development on the Gateway site,
is of benefit to the Redevelopment Project for the reason set forth above.
PASSED, ADOPTED AND APPROVED, by the City Council of the City of Poway, at a
regular meeting thereof this 11th day of May, 1999.
