A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN
OF THE CITY OF POWAY
GENERAL PLAN (GPA 99-01B)
WHEREAS, the City Council of the City of Poway recognizes that the need may
arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code describes
the procedures for amending General Plans; and
WHEREAS, Steven Stone has initiated a General Plan Amendment, GPA 99-01B,
for a modification of land use on a 9.53 acre parcel (APN 273-790-12) located on the
southeast corner of Solera Way and Tannin Drive; and
WHEREAS, the application proposes a change in land use from Open Space-
Recreation to Rural Residential-A; and
WHEREAS, to be consistent with the provisions of Poway Proposition FF, the
development density of the subject parcel shall be limited to one residential unit and prior
to the approval of a development application on the subject parcel, a specific plan shall be
prepared and approved that so limits the development density of the parcel to one
residential unit; and
WHEREAS, to ensure that this condition is known to the owners, heirs, successors
and assigns, the title report of said property shall be amended to include the
aforementioned density restriction through a deed restriction; and
WHEREAS, the City Council further finds that the proposed General Plan
Amendment would result in a land use designation that is compatible and consistent with
the existing residential land uses that border the property; and
WHEREAS, the City of Poway held a propedy noticed public hearing in accordance
with the California Government Code and the California Environmental Quality Act to
consider that request; and
WHEREAS, the City Council finds that proposed General Plan Amendment 99-01B
will not have significant adverse impact on the environment and hereby issues a Negative
Declaration.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby amend
the City of Poway General Plan Land Use Map of the Land Use Element for the above
described property from Open Space-Recreation to Rural Residential-A.
