A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AUTHORIZING LIMITED USE OF GROUNDWATER
FOR THE IRRIGATION OF MADERAS GOLF CLUB
WHEREAS, Resolution No. P-90-34 expressly provides that Developer shall
perform a groundwater hydrology analysis to determine the feasibility of the use of
groundwater until reclaimed water is available; further provides that such hydrology
analysis shall be subject to the approval of the City Council; and further expressly
provides that groundwater shall not be used without the prior approval of the City Council;
and
WHEREAS, Developer has not performed such hydrology analysis and has not
submitted it for approval of the City Council; and
WHEREAS, Developer has commenced the use of groundwater without Council
approval to irrigate the golf course now under construction and wishes to continue to use
such water pending performance and review of the required hydrology analysis.
NOW THEREFORE, BE IT RESOLVED BY THE POWAY CITY COUNCIL AS
FOLLOWS:
The City Council approves the limited use of groundwater by Developer
subject to the following conditions:
a. The duration of use hereby approved shall end March 15, 2000.
The hydrology analysis shall be commenced immediately and
submitted to the City Council for review not later than February 15,
2000.
Use of groundwater shall be immediately discontinued once potable
or raw water is available if (1) the groundwater analysis cannot be
completed, or cannot be performed accurately, while groundwater is
being used by Developer or (2) any of the six property owners with
wells in Sycamore Canyon are unable to pump sufficient groundwater
for their reasonable needs and Developer does not otherwise take
action assuring that such owners have a sufficient supply of water.
Nothing herein shall affect the discretion of the City Council to approve or
disapprove the use of groundwater for periods after March 15, 2000, or the
discretion of the City Council to repeal the approvals granted hereby if the
conditions hereof are not satisfied.
