A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
FINDING THAT THE EXPENDITURE OF REDEVELOPMENT AGENCY HOUSING FUNDS
TO PROVIDE CONSULTANT SERVICES FOR HOUSING REHABILITATION PROJECTS
OUTSIDE OF THE PROJECT AREA BENEFITS THE REDEVELOPMENT PROJECT AREA
WHEREAS, the Poway Redevelopment Agency (the "Agency") and Construction
Quality Assurance Group (CQAG) wish to enter into a contractual agreement (the
"Agreement") to provide inspection and construction management services for the
Affordable Housing Rehabilitation Program (the "Program") which assists Iow and
moderate income residents within the Paguay Redevelopment Project Area (the "Project
Area") and the City of Poway (the "City") in preserving and improving existing affordable
housing; and
WHEREAS, Section 33334.2 of the California Government Code requires that 20
percent of all tax increment allocated to the Agency be placed in a fund (the "Housing
Fund") and used to increase, improve, and preserve the community's supply of Iow and
moderate income housing available at affordable housing cost to persons and families of
very-low, Iow and moderate incomes; and
WHEREAS, Section 33334.2(g) of the California Health and Safety Code provides
that the Agency may expend Housing Fund monies outside the Project Area upon a
resolution of the Agency and the City Council that the use will be of benefit to the
Redevelopment Project; and
WHEREAS, the Agency's contract with CQAG will provide inspection and
construction management services for housing rehabilitation projects located both within
and outside of the Project Area; and
WHEREAS, the Program benefits the Project Area by revitalizing the City's older
residential neighborhoods which provide housing that is affordable to Iow and moderate
income residents. By preserving and improving existing affordable housing stock the
Program benefits adjacent industrial and commercial property located within the Project
Area because it improves the quality of affordable housing available to employees of
businesses located in the Project Area. The preservation of existing residential
neighborhoods also makes the adjacent property within Project Area more attractive to
investment; and
WHEREAS, California Health and Safety Code Section 33334.2 (e)(8) states that
the Agency may utilize funds from its Low and Moderate Income Housing Fund (the
"Housing Fund") monies to assist very Iow, Iow,and moderate income persons and families
in meeting their housing needs; and

WHEREAS, the Program will assist persons and families of Iow and moderate
incomes, as defined in Section 50093 of the California Health and Safety Code, in
maintaining safe, decent and sanitary housing at a cost which is affordable pursuant to the
definition found in California Health and Safety Code. 50052.5.
NOW, THEREFORE, the City Council of the City of Poway does resolve as follows:
Section 1: The City Council hereby finds that the foregoing statements are true and
correct, and incorporated herein.
Section 2: The City Council finds that the expenditure of monies from the Housing Fund
for consultant services provided by CQAG to the Affordable Housing Rehabilitation
Program is of benefit to the Redevelopment Project for the reasons set forth above.
PASSED, ADOPTED AND APPROVED, by the City Council of the City of Poway,
at a regular meeting thereof this 26th day of October, 1999.
