A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY, CALIFORNIA, SUPPORTING THE CITY OF
CARLSBAD IN ITS EFFORTS TO IMPLEMENT THE
CARLSBAD HABITAT MANAGEMENT PLAN (HMP) AND
THE NORTH COUNTY MULTIPLE HABITAT
CONSERVATION PLAN (MHCP)
WHEREAS, the City of Carlsbad has spent over eight years developing a
Habitat Management Plan (HMP) in conformance with the Federal and State
Endangered Species Acts, the State Natural Communities Conservation Plan (NCCP)
Program and the North County Multiple Habitat Conservation Plan (MHCP); and,
WHEREAS, the HMP is an integral component of the MHCP in that it
provides wildlife corridor linkage to all adjoining North County cities and proposes to
acquire a substantial portion of the MHCP core gnatcatcher area which is critical to
meeting the conservation standards required for the MHCP; and,
WHEREAS, the City of Carlsbad has designed its proposed Municipal
Golf Course: a) in full cooperation with the U.S. Fish and Wildlife Service and the
California Department of Fish and Game; b) in complete compliance with the HMP and
the conservation and preserve design standards contained in the Draft MHCP and;
c) has agreed to acquire land in the MHCP core area as partial mitigation for the Golf
Course; and,
WHEREAS, the City's Municipal Golf Course is located in the Coastal
Zone and the Coastal Commission has appealed the City's issuance of a Coastal
Development Permit for the Golf Course because of habitat preserve design issues
even though the course was designed in consultation with U.S. Fish and Wildlife
Service and California Department of Fish and Game and is fully consistent with the
City's HMP and the MHCP; and,
WHEREAS, if the Coastal Commission overrules the City's approval of
the Municipal Golf Course, it severely jeopardizes the HMP, the City's participation in
the MHCP, collaboration with the State and Federal Wildlife Agencies and local land
use authority.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway as follows:
The City Council supports the City of Carlsbad in its efforts to implement
its Habitat Management Plan and its contribution to the North County Multiple Habitat
Conservation Plan, particularly as it relates to the Carlsbad Municipal Golf Course.
