A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
AUTHORIZING THE SALE OF A PORTION OF 13202 POWAY ROAD
APN 317-101-10
WHEREAS, the City of Poway owns that certain real property located at 13202
Poway Road, consisting of approximately 15,000 square feet of land, upon which the
Community Services building is located; and
WHEREAS, on May 9, 2000 the City Council and the Redevelopment Agency
approved a targeted rehabilitation loan for the Poway Library Plaza to be developed by
Meissner Jacquet Investment Management Services on adjacent property and on so much
of the City property as the City is willing to sell to the developer; and
WHEREAS, on December 18, 2000 the City and Meissner Jacquet executed an
Option Agreement granting to the developer an option to purchase for $17.00 per square
foot the square footage of the property in excess of the minimum lot size and agreeing to
reconfigure the lot by means of a lot line adjustment to accommodate the redevelopment of
the Poway Library Plaza and the continued use by the City of the Community Services
building; and
WHEREAS, the portion of the property to be sold to Meissner Jacquet is needed for
the redevelopment of the Poway Library Plaza, is surplus to the needs of the City, and is
sold for the fair market value thereof.
NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Poway as follows:
Section 1. The sale of that portion of 13202 Poway Road in excess ofthe minimum lot
size as depicted in the lot line adjustment plat on the terms and conditions set forth above
is hereby approved, subject to the execution of a reciprocal access and parking agreement
approved by the City Attorney.
Section 2. The City Council declares that the subject property is surplus to the City's
needs, is needed for the redevelopment of the adjoining property, that said redevelopment
serves an important public purpose, and that the property is sold for fair market value
pursuant to the terms of the previously executed Option Agreement.
Section 3. The City Manager is hereby authorized to execute the grant deed, reciprocal
access and parking agreement, and any and all other documents necessary to complete
the sale of the subject property on the terms and conditions approved hereby.

This Resolution shall take effect upon its adoption by this Council.
