Res 01-023RESOLUTION NO. 01-023 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY FINDING THAT THE EXPENDITURE OF FUNDS FOR ACQUISITION, DEMOLITION AND DEVELOPMENT OF AN AFFORDABLE HOUSING SITE LOCATED OUTSIDE THE PROJECT AREA BENEFITS THE REDEVELOPMENT PROJECT WHEREAS, the Poway Redevelopment Agency (the "Agency") is a community redevelopment agency organized and existing under the Community Redevelopment Law, Health and Safety Code Section 33000, et seq; and WHEREAS, not less than 20 percent of all tax increment allocated to the Agency must be placed in a fund (the "Housing Fund") and used for the purpose of increasing, improving and preserving the community's supply of Iow- and moderate-income housing available at affordable housing cost to persons and families of very-low, Iow and moderate incomes; and WHEREAS, Section 33334.2(g) of the California Health and Safety Code provides that the Agency may expend Housing Fund monies outside the Paguay Redevelopment Project Area (the "Project Area") upon resolution of the Agency and the City Council that the use will be of benefit to the Redevelopment Project; and WHEREAS, in order to carry out and implement the Redevelopment Plan (the "Plan") for the Project Area and the affordable housing requirements thereof, the Agency desires to appropriate Housing Fund monies for the Brighton Avenue project, which will include acquisition, demolition and development of an Affordable Housing (AH Overlay) site located on Brighton Avenue between Temple and Edgemoor Streets, and a portion of the subject site is located outside of the Project Area; and WHEREAS, through the adoption of Resolution R-93-071, on May 25, 1993, the Agency Board made general findings that the use of Housing Fund monies to increase, improve and preserve the community's supply of Iow- and moderate-income housing located outside the Redevelopment Project Area benefits the Redevelopment Project; and WHEREAS, two of the eight parcels that make up the Brighton Avenue site (APN 314-220-66 and -67) are located immediately adjacent to the Project Area and it is estimated that the entire Brighton Avenue site will yield up to ninety-one units of affordable housing for families with very Iow incomes and that residents of the future Brighton Avenue units may be employed in nearby commercial areas that are located within the Project Area, and that they will expend personal income and support businesses located within the Project Area; and WHEREAS, the acquisition of the subject property is consistent with the AB 1290 Redevelopment and Housing Implementation Plan, as updated on June 29, 1999, which Resolution No. 01- 023 Page 2 lists the acquisition of new sites with the AH Overlay designation as one of the activities that the Agency will assist with Housing Fund monies in the period from July 1 1999 to July 30, 2004. ' NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1. The City Council hereby finds that the foregoing statements are true and correct, and incorporated herein. Section 2. The City Council hereby finds that the expenditure of monies from the Housing Fund for acquisition, demolition and development of that portion of the Brighton Avenue site located outside the Project Area is of benefit to the Project Area for the reasons set forth above.
