ENVIRONMENTAL REVIEW This project is not subject to CEQA because it is categorically exempt, Class 4(e) and 11 in that, the event is a temporary use of land that will involve the temporary siting of portable structures. FISCAL IMPACT None. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Public notice is not required for this activity. A condition of approval for this permit requires that the applicant provide a courtesy notice to the management of Poway Vi 11 as Apartment complex, Valley School and nearby businesses to the east/north and west of the carnival a minimum of one week before setup for the event. RECOMMENDATION It is recommended that the City Council approve Temporary Use Permit 96-39 subject to the conditions contained in the attached proposed resolution. BACKGROUND Section 17.26.030A of the Poway Municipal Code provides regulations for temporary uses within the City. The Code requires a temporary use permit approval by the City Council for major outdoor events or enterprises. FINDINGS Jim Vesey and the Poway High School Band Boosters are requesting approval to sponsor an amusement carnival on the future library/former Western Lumber site on Thursday, June 13, 1996 through Sunday, June 16, 1996. The carnival is intended to be a fundraising venture by the Poway High School Band. Christiansen Amusements plans to begin setup of the carnival on Monday June 10, 1996, and will breakdown on Monday, June 17, 1996. The carnival will be sited on the northern half of the lot along Poway Road. The adjacent Redevelopment Agency property on the corner of Bowron Road and Civic Center Drive will be made available for carnival users parking. The carnival will include adult and kids rides, games and food concessions. The hours of operation for the carnival will be 5-10 phm. on Thursday, 5-11 p.m. Friday, 1-11 p.m. Saturday and 1-10 p.m. on Sunday. P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 96-39 WHEREAS, Temporary Use Permit 96-39, Jim Vesey and the Poway High School Band Boosters, applicants, requests approval to sponsor a fundraising carnival presented by Christiansen Amusements on the future library/former Western Lumber site located at the intersection of Poway Road and 80wron Road on June 13, 1996 through June 16, 1996; and WHEREAS, on June 4, 1996 the City Council considered the above-referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental FindinQs: Pursuant to the procedure of the City of Poway, this project is not subject to CEQA because it is categorically exempt, Class 4(e) and 11 in that, the event is a temporary use of land that will involve the temporary siting of portable structures. Section 2: FindinQs: That the proposed use is in accordance with the purposes and standards of Section 17.26.030 of the Poway Municipal Code. Section 3: Citv Council Decision: The City Council hereby approves Temporary Use Permit 96-39 subject to the following conditions: APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. The site shall be utilized in accordance with the approved site plan on fi 1 e in the Pl anni ng Servi ces Department and the condi t ions contained herein. 2. Approval of this activity shall not excuse compl iance with all other sections of the Zoning Ordinance and all other applicable City ordinances presently in effect. 3. All temporary signs shall be reviewed by the Planning Services Department for compliance with the Sign Ordinance prior to installation. The community event Kiosks and posters in commercial window fronts shall be the primary means of signage. All temporary signs will be removed by June 17, 1996. 4. Noise generated by the activity shall comply with the Noise Ordinance for Commercial General zone, i.e. 55.decibel one-hour average sound level between 7:00 p.m. and 7:00 a.m. and 60 decibel limit between 7:00 a.m. and 7:00 p.m. as measured at the property lines. Any speakers used for music or sound amplification shall be directed inward toward the event area. 4 of 9 A TT ACHMENT A JUN 4 1996 ITEM 1 9 f Resolution No, p- Page 2 5. The applicants shall provide liability insurance for the carnival to the City, prior to the event, an insurance policy naming the City as ADDITIONALLY INSURED for a minimum of SI,OOO,OOO. 6, A sign showing location of the restrooms must be posted. 7. Any dumpsters used for the event must be removed by June 19, 1996. 8. Inspection from the State Division of Industrial Safety shall be obtained for the amusement rides and equipment. 9. Provision for temporary electrical power will require an electrical permit and an inspection approval by the Building Safety Inspection Division, 10. The applicant shall provide a courtesy notice to the management of the Poway Villas Apartment Complex located on Civic Center Drive, Valley School and nearby businesses to the east, north and west of the carnival a minimuf of one week before setup for the event. 11. The eve t sites shall be 1 eft free of debri s, litter, or any other evidence of the temporary use upon completion of the use. 12. This approval shall become null and void on the evening of June 16, 1996 at which time the site shall be restored to its original condition. APPLICANT SHA L CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE WITH THE FOLL ING CONDITIONS: 1. Do not lock emergency vehicle access to the site, any street, or fire hydrant. 2. All boo hs are to be tagged with State Fire Marshal approval. 3. Fire ex inguishers shall be provided within 75 feet of travel. The minimum rating of each fire extinguisher shall be 2AI0BC. 4 Maintain emergency vehicle access to all buildings, streets, fire hydrants and sprinkler connections affected by the carnival. 5. Grass an weeds in the field being used for parking shall be cut so as to not pre ent a fire hazard. The following improvements shall be accompl ished to the satisfaction of the Director of E gineering Services: 1. Appl ica t shall provide adequate off-street parking commensurate with expecte attendance. Ten di sabl ed access i bl e parki ng spaces shall be designa ed in the paved parking area adjacent to Bowron Road behind the carnival site. Off-street parking on any adjacent vacant lots would require the permission of the property owner for the specified period of use, e. . Valley School or City Center Plaza. 5 of 9 JUN 4 1996 ITEM 1 9 Reso 1 ut i on No. P- Page 3 2. Traffic control plans showing parking availability and ingress and egress signage shall be provided. Pedestrian crossing from the parking lot to the carnival location shall be properly marked. Signs and personnel shall be posted to insure pedestrians cross roads at intersections only, e.g. from the City Center Plaza lot north of Poway Road. 3. The traffic control plan shall identify the number of individuals (Sheriffs deputies, reserve deputies, volunteers) required for traffic control. Traffic control personnel must be properly trained, wear reflective vests and carry flashlights. 4. Bowron Road shall be temporarily closed to parking along the curbs for the duration of the event in order to facilitate safer pedestrian circulation. The following conditions shall be completed to the satisfaction of the County Health Department. 1. A minimum of four chemical restrooms shall be provided on site, including at least one disabled accessible restroom. 2. A 11 food and dri nk concess ions operated for profi t shall secure the necessary Health Department permit and state seller s permit. 3. Require waste water disposal from food units to acceptable sewer or holding tanks. APPROVED and ADOPTED by the City Council of the City of Poway, State of California, this 4th day of June, 1996.
