A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
APPROVING A SPECIFIC PLAN AMENDMENT (SPA 84-01YY) TO THE
SOUTH POWAY SPECIFIC PLAN TO ESTABLISH THE RESIDENTIAL APARTMENT
LAND USE DESIGNATION AND TO CHANGE THE LAND USE DESIGNATION
OF AN 8-ACRE PORTION OF A 32.72oACRE SITE FROM MOBILE HOME PARK
(MHP) TO RESIDENTIAL APARTMENT (PA)

WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning
Development Code) of the Poway Municipal Code provides the requirements for the
initiation, preparation and adoption of Specific Plans in accordance with Section 65450,
et seq. of the California Government Code (Article 8, Specific Plan); and
WHEREAS, Section 17.47.020.C (Initiation) of the Zoning Development Code
provides that the City Council may initiate the preparation of, or amendment to, a
Specific Plan on property by resolution; and
WHEREAS, on May 22, 2001 the City Council initiated Specific Plan Amendment
84-01YY by Resolution; and
WHEREAS, Specific Plan Amendment 84-01YY is proposed to establish in the
South Poway Specific Plan the Residential Apartment land use designation and to
change the designation of the 8-acre portion of a 32.72-acre site from Mobile Home
Park to Residential Apartment (RA) located near the southeast corner of Community
Road and Civic Center Drive within the South Poway Specific Plan Planned Community.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: The City Council has considered the Environmental Initial Study (ELS),
Mitigated Negative Declaration (MND), and associated Mitigation Monitoring Program
shown as Exhibit A of this Resolution for Specific Plan Amendment 84-01YY and public
comments received on the ElS and MND. The subject ElS and MND documentation is
fully incorporated herein by this reference. The City Council finds that the mitigation
measures contained in the ElS and Exhibit A hereof will mitigate potentially significant
impacts to a less than significant level and hereby approves the MND and the
associated Mitigation Monitoring Program attached to this Resolution as Exhibit A.
Section 2: The City Council hereby approves Specific Plan Amendment (SPA 84-
01YY) as follows:
Chapter 4 of the South Poway Specific Plan Development Standards is amended
to add the following residential land use designation:

The Residential Apartment (RA) land use designation is intended as an area
for the development of residential apartments with provisions for adequate
light, air, open space and landscaped areas at a maximum density of 25 living
units per net acre with a 25% density bonus issued by the City Council for
Affordable Housing (AH) projects. Additional uses are permitted that are
complementary to, and can exist in harmony with a residential apartment
development.
The fourth paragraph in Chapter 4 of Volume II Development Standards of the
South Poway Specific Plan is amended to read as follows:
For areas not designated Open Space - 1 dwelling unit, the total residential
density for the South Poway Planned Community shall be allocated as follows
in order to preclude development from steep slopes that could create
significant visual impacts, to avoid areas with little or no infrastructure or
limited or difficult access:

Figure 48 in Volume 1 Development Plan of the South Poway Specific Plan is
hereby amended to indicate the land use designation an 8-acre portion of a
32.72-acre two-parcel site located near the southeast corner of Community Road
and Civic Center Drive, is hereby changed from Mobile Home Park to Residential
Apartment (RA). The subject 8-acre site is a portion of a two-parcel property,
totaling 32.72 acres (27.72 and 5.15, respectively), and is located near the
southeast corner of Community Road and Civic Center Drive. The two parcels
are legally defined as a portion of the southwest quarter of the southeast quarter
of Section 13, Township 14 South, Range 2 West, of North San Bernardino
Meridian. Parcel 2 is Parcel 1 of Parcel Map No. 15715, in the City of Poway,
County of San Diego, State of California, June 21, 1989 as File No. 89-328217.
The parcels are further defined as APN 317-480-10 & 13.
