ABSTRACT
On December 13, 1994, the City Council introduced and had the first reading on
Ordinance No. 441 - "An Ordinance of the City of Poway, California, Amending Section
13.24.070 of the Poway Municipal Code Regarding Payment for Reimbursement." Staff
recommends adoption.

Notice was published in the Powav News Chieftain prior to first reading of the

If the City Council desires to adopt, read title and waive further reading of the
Ordinance by unanimous vote. Pass motion closing public hearing and adopting (roll
call vote).

BACKGROUND
On December 13, 1994, the City Council introduced and had the first reading on
Ordinance No. 441 - "An Ordinance of the City of Poway, California, Amending
Section 13.24.070 of the Poway Municipal Code Regarding Payment for
Reimbursement." Staff recommends adoption.

It is in order to have the second reading and adopt this Ordinance.

AN ORDINANCE OF THE CITY OF POWAY AMENDING
SECTION 13.24.070 OF THE POWAY MUNICIPAL CODE
REGARDING PAYMENT FOR REIMBURSEMENT

Whereas, the City Council periodically finds it necessary to amend the
Municipal Code in response to changing conditions; and
Whereas, this amendment is exempt from the provisions of the California
Environmental Quality Act (CEQA); and
Whereas, the City Council held a duly advertised public hearing to
provide interested parties the opportunity to address the proposed amendment.
NOW, THEREFORE, be it ordained that the City Council of the City of Poway
does hereby amend Section 13.24.070 of the Poway Municipal Code as follows,
with deletions lined out and additions highlighted:
SECTION 13.24.070 Payment for reimbursement. The approved agreement
~b~JJprovide that the City of Poway shall agree for a period of teft
rJftiii;i!j years from the date of the agreement, to reimburse to the
aPplIcant the fo 11 owi ng sums:
D. The applicant shall be entitled to receive the reimbursement provided
in this section for the period of time specified in this section, or
until all payments as specified in the reimbursement agreement have been
repaid to the applicant, whichever occurs first. Following full
reimbursement to the applicant as provided in this section, or upon
automatic termination of the agreement at the end of teft ~if~g[ñ years

reimbursements arising out of benefit charges which might be charged by
the City, and all payments thereafter accruing shall be and become the
property of the City.
EFFECTIVE DATE: This ordinance shall take effect and be in force thirty
(30) days after the date of its passage; and the City Clerk of the City of
Poway is hereby authorized to use summary publication procedures pursuant to
Government Code Section 36933 utilizing the Poway News Chieftain, a newspaper
of general circulation published in the City of Poway.
Introduced and first read at a regular meeting of the City Council of the
City of Poway held the 13th day of December, 1994, and thereafter PASSED AND
ADOPTED at a regular meeting of said City Council held the 3rd day of January,
1995, by the following roll call vote:
