Sharon DeYounQ. ADDlicant: A request to operate a truck rental business within the City Center Plaza located at 13166 Poway Road in the CG(Commercial General) zone. APN: 317-101-09, 31 BACKGROUND Section 17.10.080.22 of the Poway Municipal Code allows truck rental businesses within the CG zone with the approval of a conditional use permit. The applicant is requesting approval to operate a truck rental office at 13166 Poway Road in the City Center Plaza commercial center. FINDINGS The proposed use is to be located in a vacant 1260 square foot suite located immediately north of Poway Merchandise Exchange (pawn shop). The building is located at the rear of the center. The applicant intends to park approximately 15 trucks ranging in size from 14 feet to 24 feet long directly behind the leased premises in the rear of the building. Commercial uses adjoin the site on the west, south and east. Single family homes are adjacent to the north on lots approximately 10 feet hi gher in e 1 evat i on. The closest home is approximately 90 feet away from the proposed truck storage area. There will be no repair or servicing of the vehicles on the site. The proposed hours of operation are between 8:00 a.m. and 5:00 p.m. Customers will be able to return trucks after hours by parking the vehicle and depositing the keys in an on-site drop box. The applicant proposes to provide trucks which use unleaded r ACTION, 2 of 9 JAN 3 1995 l1ëM 9 - - - Agenda Report January 3, 1995 Page 2 fuel only, therefore truck engine noise will be less than that of diesel trucks. To minimize potential late night/early morning truck engine noise impacts to adj acent residential development, a condition of approval for the project requires that customers returning trucks between the hours of 10:00 p.m. and 7:00 a.m. be instructed to park the vehicles in the parking area in the front of the center. DeveloDment Facilities No changes have been proposed for the exterior of the building. Only minor tenant improvements will be necessary. The subject shopping center has been fully improved and all required public facilities are available. Conditions of approval for the project require that disabled access be provided within the tenant suite and the center fire lane be re-painted and signage installed to meet current fire safety standards. Section 17.10.150.B of the Municipal Code requires that a commercial use install an eight foot high masonry wall if locating adjacent to a residential zone. In that the use is occupyi ng existing commercial facilities and the adjacent residential properties are fenced and walled off from the subject property and -- are elevated more than eight feet above the area that would be enclosed by the wall, it i s recommended that the requi rement to i nsta 11 the masonry wall be waived. ENVIRONMENTAL REVIEW The project is categorically exempt, Class 1 from the California Environmental Quality Act in that the project will be occupying existing facilities. FISCAL IMPACT None. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Public notice was published in the Poway News Chieftain and mailed to 88 property owners in the project area. In late November, the applicant delivered flyers describing the proposed business to adjacent residential neighbors to solicit and address any concerns and issues. At the time of the preparation of this report, Ms. DeYoung advised she has not been contacted by neighbors re9arding the project. P- - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING CONDITIONAL USE PERMIT 94-18 ASSESSOR'S PARCEL NUMBER 317-101-09,31 WHEREAS, Condi t i ona 1 Use Permit 94-18, submi tted by Sharon DeYoung, applicant, requests approval to operate a truck rental business within the City Center Plaza located at 13166 Poway Road in the CG zone; and WHEREAS, on January 3, 1995, the City Council held a hearing on the above- referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Sect i on 1: Environmental Findinos: The City Council finds that this project is categorically exempt Class 1 from the California Environmental Quality Act in that the use will be occupying existing commercial facilities. Section 2: Findinos: 1. The proposed project is consistent with the general plan in that the project is located in the Commercial General zone which permits truck rental businesses subject to issuance of a conditional use permit. 2. That the location, size, design, and operating characteristics of the use will be compatible with and will not adversely affect or be materially detrimental to adjacent commercial uses, residents, buildings, structures, or natural resources in that the use will be occupyi ng existing commercial facilities and the adjacent residential uses are adequately buffered from the site by a significant grade separati on and existing walls, fencing and landscaping. 3. That the scale, bul k, coverage, and density is consi stent wi th adjacent uses, in that the truck rental business will be occupying existing commercial facilities and no expansion or exterior ~teration to the building is proposed. 4. That there are available public facilities, services, and utilities to serve the use. 5. That there will not be a harmful effect upon desirable neighborhood characteristics, in that the physical separation between residential and commercial uses will be adequate. 6. That the generation of traffic will not adversely impact the surrounding streets and/or the City's Circulation Element in that the use is not anticipated to cause a significant increase in traffic and the center has adequate parking spaces for this establishment. 5 of 9 JAN 3 1995 ITEM 9 ---- Resolution No. P- Page 2 7. That the site is suitable for the type and intensity of use as no increase in intensity is proposed beyond which already exists on the site. 8. That there wi 11 not be significant harmful effects upon the environmental quality and natural resources in that the site has been completely developed. 9. That there are not other relevant negative impacts of the use that cannot be mitigated. Section 3: City Council Decision: The City Council hereby approves Conditional Use Permit 94-18 subject to the following conditions: 1. Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. 2. The use conditionally granted by this permit shall not be conducted in such a manner as to i nterfere wi th the reasonabl e use and enjoyment of surrounding residential and commercial uses. 3. This conditional use permit shall be subject to annual review by the Director of Planning Services for compliance with the conditions of approval and to address concerns that may have occurred during the past year. If the permit is not in compliance with the conditions of approval, or the Planning Services Department has recei ved complaints, the required annual review shall be set for a public hearing before the City Council, to cons ider modification or revocation of the use permit. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. SITE DEVELOPMENT 1. Si te shall be developed i n accordance with the approved site pl ans on fi 1 e in the Planning Services Department and the conditions contained herein. 2. Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. 3. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit issuance. 4. The property owner shall comply with all applicable standards for disabled access. JAN 3 1995 'TEM 9 6 of 9 - - Resolution No. P- Page 3 - 5. Prior to any use of the project site or business activity being commenced thereof, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. 6. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit issuance. 7. This approval shall become null and void if building permits are not issued for this project withi n two years from the date of project approval. 8. Trucks shall not be servi ced (i .e., oil changes, fiuid levels topped, etc.), repaired or detailed on-site. 9. The applicant shall contact the Customer Services Department and obtain a business license prior to the onset of business activity. PARKING AND VEHICULAR ACCESS 1. Customers sh~l be instructed to park trucks returned after business hours (between 10:00 p.m. and 7:00 a.m.) in the front of the center. The trucks -- shall be relocated to the designated storage/parking area at the back of the center upon the start of the business day. SIGNS 1. Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. 1. Pri or to the onset of busi ness acti vity desi gnated fi re 1 anes shall be established with proper painting and signage.
