Within Multi-Family Dwelling Units
ABSTRACT
In accordance with Section $.1 o£the exclusive solid waste franchise agreement, awarded at the September 20,
1994 meeting, the City Council shall approve, by resolution, the rates in eff'ect at the inception of the agreement.
It is recommended the City Council approve the attached resolution expanding the schedule ot rates offered by
Mashburn Waste and Recycling Services for multi-family dwelling complexes as supplementary to those rates
already approved to take effect Januav/1, 1995. The rate schedule as approved on November 29, 1994, remains
in effect.

and Recvclables Within Multi-Family Dwellino Units
BACKGROUND
At the September 20, 1994, meeting, the City Council awarded the exclusive Solid Waste Franchise
to the lowest responsive, responsible bidder, Mashburn Waste and Recycling Services, in the
aggregate and extended unit price amount of $3,758,936.68. At the November 29, 1994, meeting,
the City Council approved by adoption of Resolution No. 94-125, the unit prices submitted by
Mashbum Waste and Recycling Services for the various services included in the franchise agreement
solicitation. These unit prices were submitted on September 1, 1994, and when extended to the total
estimated number of service units required under the franchise, comprised the extended and
aggregate total bid.
To keep the bidding process manageable, some service areas such as for centrally-billed, multi-
family collection of refuse, recyclables and green waste, were kept as simple in definition as
possible· Recognizing that other services might also be required, it was agreed during the Pre-bid
Conference attended by all bidders and the City, that post-award negotiation possibly would be
necessary to refine unit prices for multi-family services.
FINDINGS
As reported to the City Council on December 13, 1994, Mashburn Waste and Recycling Services
and Staff negotiated additional refinements to centrally-billed, multi-family service rates. Retaining
the basic rates as originally bid, these refinements provide additional opportunity for various sizes
of collection containers as well as options for multiple weekly collections. Attachment 1 provides

the expanded pricing table for these options. Further, recognizing that some of these multi-family
complexes may employ gardener services that include disposal of green waste, Attachment 1 offers
an alternate pricing table that excludes green waste collection and disposal. In each case, the rates
include provision of 100-gallon "OTTO" containers for the separation and collection of recyclables.
A requirement of ARTICLE 8, Section 8.1 of the Franchise Agreement specifies that the unit prices
for various types and levels of service under the franchise, shall be approved by resolution of the
City Council. This requirement applies to the rates to be in effect at the inception of the agreement.
Attached is the proposed resolution for the additional, expanded service definition rates for centrally-
billed, multi-family customers, as submitted by the contractor, Mashbum Waste and Recycling
Services.

RECOMMENDATION
It is recommended that the City Council adopt the attached resolution, Attachment 1, approving
Mashbum Waste and Recycling Services' rate charts for the collection of solid waste and recyclables
at multi-family dwelling complexes that employ central billing services, and which will supplement
the rate schedule approved by the City Council on November 29, 1994.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA APPROVING MASHBURN WASTE AND RECYCLING SERVICES'
RATE SCHEDULE FOR MULTI-FAMILY DWELLING UNITS
WHEREAS, the City Council awarded the exclusive Solid Waste Franchise Agreement to
the lowest responsive, responsible bidder, Mashburn Waste and Recycling Services, in the aggregate
and extended unit price amount of $3,758,936.68; and
WHEREAS, on November 29, 1994, the City Council adopted Resolution No. 94-125
approving Mashbum Waste and Recycling Services' unit price rate schedule as they had bid them
on September 1, 1994, and as set forth in the Solid Waste Franchise Agreement; and
WHEREAS, the rate structure adopted on November 29, 1994 does not address multiple
service days or various bin sizes currently being used by multi-family complexes, nor does it address
complexes having a single billing for all units served through a homeowners association; and
WHEREAS, staff has determined the need for the franchisee to develop a rate schedule to
better serve the diverse needs of multi-family complexes; and
WHEREAS, ARTICLE 8 of the Franchise Agreement requires the franchisee's rates be
established by City Council resolution;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1. The rate schedule for the collection of once weekly curbside collection pickup
and disposal of unlimited general rubbish, including curbside collection of recyclables and yard
waste at multi-family residential complexes, who have a single billing for all units served through
a homeowners association is hereby established at $10.15 per unit; and
Section 2. The following rate chart options for multi-family dwelling complexes using bin
services including recycling, and green waste bins, as submitted by said contractor, are hereby
adopted.
