Nelson, Management Aide DATE: January 10, 1995 SUBJECT: Approval of the Application and Letter of Authorization for Grant Funds from the Used Oil Recycling Fund - Third Cycle - Under the Used Oil Recycling Enhancement Act The California Oil Recycling Enhancement Act (Statutes of 1991, Chapter 817) mandates the California Integrated Waste Management Board (CIWMB) to annually provide block grants to local governments for establishing local used oil collection programs that encourage recycling or appropriate disposal of used oil, A grant application submitted to the CIWMB on December 16. 1994. A letter from the City Manager was included with Poway's application stating that the item would be considered at tonight's meeting, Conditions of grant consideration by the CIWMB is that a Council approved resolution _ and letter of authorization be submitted to their office by February 17, 1995, ENVIRONMENTAL REVIEW Environmental review is not required for this agenda item. Nelson, Management Aide~--~ ~ DATE: January 10, 1995 SUBJECT: Approval of the Application for Grant Funds from the Used Oil Recycling Fund - Third Cycle - Under the Used Oil Recycling Enhancement Act BACKGROUND California's used oil laws prohibit the disposal of used oil by discharge into sewers, drains, surface or groundwaters, by incineration or burning as a fuel. or deposit on land. unless otherwise authorized by law. The City of Poway applied for and received first- and second-cycle funding from the CIWMB noncompetitive Used Oil Recycling Block Grant for January 1994 through June 1995. Funds obtained by the approval of this grant (third cycle) are intended to cover expenses during fiscal year 1995/96 for the continuation and development of local used oil collection programs within the City. FINDINGS The City of Poway meets the requirements to receive funding from this grant. in that it has within its jurisdiction one State certified collection center - Chief Auto Parts. Chief Auto Parts. Kragen Auto Works. and the City's Vehicle Maintenance Facility are currently participating in used oil and oil filter collection for recycling or proper disposal. .A?TION: 2of6 JAN 1 0 1995 I'F~:~VI 1C Agenda Report - Used Oil Recycling Grant Application Approval January lO. 1995 Page 2 As of this date, first and second cycles of the CIWMB program provided Poway with funds for: Purchase and distribution of over 1,200 used oil recycling containers - free of charge to Poway residents Purchase of two oil filter crushers to realize used oil filters contain · Purchase of a large-capacity (400 gallons) collection container which was placed at the City's Vehicle Maintenance Facility Purchase of two recycling igloos, drums, and spill pans for collection of oil filters at Kragen Auto Works and the City's Vehicle Maintenance Facility , Printing Used Oil Recycling Information cards and point-of-purchase distribution · Publication of advertisements and articles The purpose of the City's application for Third-Cycle funding is to continue and expand current City programs. Potential collection centers will be solicited to become Board certified, wherein the City will offer assistance in permitting, construction, and purchase of necessary equipment. Education efforts are proposed to include a City hotline and school awareness programs. Cooperative efforts with private businesses, the City's franchise hauler, and various civic/non-profit organizations will also be sought to assist in the City's implementation of the program. CALIFORNIA APPROVING THE APPLICATION FOR GRANT FUNDS FROM THE USED OIL RECYCLING FUND [THIRD CYCLE] UNDER THE USED OIL RECYCLING ENHANCEMENT ACT FOR RESIDENTIAL PUBLIC EDUCATION AND COLLECTION OF USED OIL AND OIL FILTERS WITHIN THE JURISDICTION OF THE CITY OF POWAY WHEREAS. the people of the State of California have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil: and WHEREAS, the California Integrated Waste Management Board has been delegated the responsibility for the administration of the program within the State. setting up necessary procedures governing application by cities and counties under the program; and WHEREAS, the applicant will enter into an agreement with the State of California for development of the project; NOW. THEREFORE. BE IT RESOLVED that the City of Poway authorizes the submittal of an application to the California Integrated Waste Management Board for a 1995/96 [Third Cycle] Used Oil Recycling Block Grant. The City Manager. Director of Public Services, or their designee, is hereby authorized and empowered to execute in the name of the City of Poway all necessary applications, contracts, payment requests, agreements, and amendments hereto for the purposes of securing grant funds and to implement and carry out the purposes specified in the grant application.
