A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
APPROVING A SPECIFIC PLAN AMENDMENT (SPA 84-01ZZ) TO THE SOUTH
POWAY SPECIFIC PLAN ESTABLISHING DEVELOPMENT STANDARDS FOR THE
INSTALLATION AND OPERATION OF LIGHTNING PROTECTION DEVICES
WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning
Development Code) of the Poway Municipal Code provides the requirements for the
initiation, preparation and adoption of Specific Plans in accordance with Section 65450,
et seq. of the California Government Code (Article 8, Specific Plan); and
WHEREAS, Section 17.47.020.C (Initiation) of the Zoning Development Code
provides that the City Council may initiate the preparation of, or amendment to, a
Specific Plan on property by resolution; and
WHEREAS, on April 5, 2001, the City Council held a workshop and considered a
proposal by Geico Direct, the applicant, to amend the South Poway Specific Plan with
regard to lightning protection devices; and
WHEREAS, on June 5, 2001, the City Council initiated this amendment to the
South Poway Specific Plan to establish development standards for the installation and
operation of lightning protection devices; and
WHEREAS, on August 14, 2001, the City Council held a duly advertised public
hearing, considered all recommendations by staff and public testimony.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: The City Council finds that this project is categorically exempt from the
California Environmental Quality Act (CEQA) as a Class 11 exemption (pursuant to the
CEQA Guidelines, Section 15311) in that the project involves the establishment of
development standards for the placement and operation of minor structures which are
accessory to commercial and industrial facilities, and will not have an effect on the
environment.
Section 2: Chapter 3, Section IV of the South Poway Specific Plan are hereby
amended as follows:
A. Subsection A.3, Height, is amended to add the following:

Lightning protection devices may project above the height limit a
maximum of fifteen feet, subject to the standards specified in
subsection 4(f).
B. Subsection A.4, Equipment Screen, is amended to revise the title to
Equipment Installations and Screening and to add the following:

Lightning protection devices shall comply with all of the following:
1. Lightning protection devices may be installed on the roof.
Ground-mounted or building facade-mounted devices are
prohibited.
Lightning protection devices shall be designed to be retractable.
Retractable lightning protection devices shall be retracted when
not in use or when not needed because of climactic conditions.
C. Subsection A.5, Color, is amended to add the following:
e. Lightning protection devices shall be painted a neutral color that
blends into the skyline.
Section 3: The City Councils finds that the proposed amendment to the South Poway
Specific Plan is consistent with the City of Poway General Plan in that:
The establishment of provisions for the installation and operation of lightning
protection devices will minimize injury, the loss of life, and property damage
resulting from natural hazards pursuant to Goal VII of the Public Safety
Element of the General Plan; and
The establishment of development standards aimed at minimizing potential
visual impacts and preserving the visual qualities of the City pursuant to Goal
IV of the Resources Element of the General Plan.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Poway,
State of California, at a regular meeting this 14th day of August 2001.
