DATE: January 31, 1995 SUBJECT: Acceptance of Public Improvements and Grading, and Release of Securities for Creekside Plaza - TM 90-05(R) and G802-92; ADI Properties, Applicant ABSTRACT The improvements and grading for T~tative Map 90-05(R), known as Creekside Plaza, are ready for approval. The conditions of approval have been met, all required dedications have been made, and all fees, charges, and deposits were paid. A Standard Agreement for Construction of Public Improvements was signed and the required securities were posted. ENVIRONMENTAL REVIEW This action is "ministerial" and not subject to CEQA review. FISCAL IMPACT Maintenance of the facilities becomes the City's responsibility six months after acceptance. There is a one year warranty period of which six months have expired. RECOMMENDATION It is recommended that the City Council accept the public improvements and grading for this project, and authorize the release of the securities. Free, Associate Civil Engineero,~, DATE: January 31, 1995 SUBJECT: Acceptance of Public Improvements and Grading, and Release of Securities for Creekside Plaza - TM 90-05(R) and G802-92; ADI Properties, Applicant BACKGROUND: Creekside Plaza, TM 90-05(R), consisting of nine commercial lots (Attachment 1) was approved by Council on January 14, 1992, Resolution No. P-92-03. The Final Map was approved by Council on December 1, 1992. The Standard Agreement for the project was executed on December 1, 1992. The improvement plans and final grading plans were approved on December 29, 1992. The improvements included grading, streets, sewer, water, and storm drain. FINDINGS: The Engineering Services Department has reviewed the facilities and found them complete and ready for acceptance, and the securities ready for release. The grading is complete and the grading bond is ready to be released. The improvements have been completed for approximately six months and the road has been open for public use for over one year. The developer filed a Notice of Completion over six months ago and has supplied staff with a current title report which indicates there are no outstanding liens on the property, The payment bond is due for renewal by the developer now. This bond is usually held for go days after acceptance of the project. Staff recommends release of the payment bond at this time since all financial obligations were satisfied by the developer. Staff also recommends not requiring the developer to post warranty securities as required in the Standard Agreement since the public improvements have been used by the public for over six months. This cash deposit will be returned to the developer six months from acceptance provided no claims are filed against it. FISCAL IMPACT: Maintenance of the facilities becomes the City's responsibility six months after acceptance. There is a six month warranty period. ENVIRONMENTAL IMPACT: This action is not subject to C.E.Q.A. review. PUBLIC NOTIFICATION & CORRESPONDENCF: A copy of this report has been sent to George Codling, ADI Properties, Inc. RECOMMENDATION: It is recommended that the City Council take the following actions: 1. Accept the public improvements and grading. 2. Authorize release of the following bonds all issued by Fireman's Fund Insurance Company: Monument Performance Bond; Performance Bond No. 111 4147 8914; Payment Bond No. 111 2719 5037; and Grading bond No. 111 4147 8906.
