SUBJECT: Temporary Water Connection for APN 314-660-05, Northerly
Terminus of Budwin Lane; Michael Meyer, Applicant
Michael Meyer has submitted a request for a temporary water connection for property he
owns at the northerly terminus of Budwin Lane. It would be an excessive financial
burden to require him to construct a public water main to service the property.
Staff recommends that City Council approve this request for a temporary water
connection.

This action is not subject to C.E.Q.A. review.

RECOMMENDATION
It is recommended that the City Council grant this request for a temporary water
connection to serve Assessor's Parcel No. 314-650-05, subject to the conditions listed
in the report.

SUBJECT: Temporary Water Connection for APN 314-650-05, Northerly
Terminus of Budwin Lane; Michael Meyer, Applicant
BACKGROUND:
The subject property is located at northerly terminus of Budwin Lane
(Attachment 1). It is a vacant lot 5.54 acres in size. Mr. Meyer would like
to develop the lot by building a single family residence.
The property is approximately 1,000 feet from the nearest water main
(Attachment 2).
FINDINGS:
I. A requirement of the owner to construct a City water main to serve
this parcel would be an excessive financial burden.
2. The standard "Agreement Respecting Temporary Water Connection"
provides that should a City water main be installed adjacent to
owner's property or at a location from which City then determines is
to be the point of permanent connection, the temporary connection
shall be terminated and a connection to the new City main required.
Also, provided for by this agreement is payment of the parcel's
proportionate share of the cost of installation of such new main(s).
3. The rules and regulations allow the City Council to approve an
application for a temporary service to account for unusual
conditions.

PUBLIC NOTIFICATION & CORRESPONDENCE:

RECOHHENDATION:
It is recommended that the City Council grant this request for a temporary
water connection to serve Assessor's Parcel No. 314-650-05, subject to the
following conditions:
1. Payment of all related fees and costs.
2. Execution by the owner of a standard "Agreement Respecting Temporary
Water Connection." A lot book report or title report shall be
provided by the owner to verify ownership.
3. Acquisition of necessary private easements for the water line.
4. Acquisition of a right-of-way permit for connection to the public
water main.
5. Completion of all of the above conditions within six months of City
Council approval, if granted, otherwise the approval shall be deemed
expired.
