SUBJECT: Extension of Standard Agreement for TM 88-13 and TM 90-04;
Allan Royster, Applicant
ABSTRACT
As a condition of approving the final maps for Tentative Map 88-13 and Tentative Map
90-04, Allan Royster was required to enter into a "Standard Agreement for Public
Improvements" for each map to insure completion of the public improvements within two
years from the date of each agreement. The Standard Agreement for TM 88-13 expired in
November, 1991 and the Standard Agreement for TM 90-04 expired in June, 1994. The
adverse economic conditions during the past two years have made it economically
unfeasible to develop the parcels. He is requesting a two year extension of the
Standard Agreements.

This action is not subject to C.E.Q.A. review.

None.
RECOMMENDATION
It is recommended that the City Council approve the time extension of the "Standard
Agreements for Construction of Public Improvements" for TM 88-13 until February 28,
1996 and TM 90-04 until February 28, 1997.

SUBJECT: Extension of "Standard Agreement for Public Improvements for
Tentative Map 88-t3 and Tentative Map 90-04; Allan Royster,

BACKGROUND:
Allan Royster is the owner of the development located at the southeast cornert
of Stone Canyon Road and Pomerado Road (Attachment 1). The property is being
developed in two phases. Phase one is Tentative Map 88-13, and is commonly
referred to as Stone Canyon Court. The second phase is Tentative Map 90-04
and is commonly referred to as Footman Lane II. The final map for both phases
has been approved and recorded. As a condition of final map approval, Mr.
Royster was required to enter into a "Standard Agreement for Public
Improvements" for each phase in order to insure that the public improvements
to be constructed for the development be completed within two years from the
date of the agreements.
The improvements for the first phase, Stone Canyon Court, have been
substantially completed. The improvements that need to be completed include
construction of sidewalk, curb, and gutter in front of the few remaining
unsold lots, and installation of the final lift of asphalt pavement throughout
Stone Canyon Court. The improvements for the second phase, Footman Lane II,
have not been started.
The "Standard Agreement for Public Improvements" for the first phase was
executed on December 1, 1989 and likewise on June 1, 1992 for the second
phase. Accordingly, Mr. Royster has requested an extension of both agreements
(Attachment 2).

FINDINGS:
Due to the decline in the economy in the past few years in California, home
sales have not been good. It would have been economically unsound to proceed
with the development of the subject property.
FISCAL IMPACT:
None.
ENVIRONMENTAL IMPACT:
This action is not subject to C.E.Q.A. review.
PUBLIC NOTIFICATION & CORRESPONDENCF:
None
RECOMMENDATION:
It is recommended that the City Council approve the time extension of the
"Standard Agreement for Construction of Public Improvements" for Tentative Map
88-13 until February 28, 1996 and Tentative Map 90-04 until February 28, 1997.

We have been unable to complete development of the property as
planned due to the downturn in the economy. FOOTMAN LANE II is from
an economic viewpoint dependent upon the success of STONE C~kNYON
COURT, that project to the immediate east. SCC has only been able
to build and sell four of their planned eight houses in the last
two years. Until they have closed escrow or at least six houses in
the SCC project FL II feels it would economically unsound to
proceed with development of their property.
The positive news is that two new starts are planned for SCC in
March, hopefully which result in additional sales. Concurrent with
the new starts in SCC the FL II investors have instructed ROYSTER
CONSTRUCTION CO. INC. to begin re-bidding the offsite costs of
their project.
I would appreciate you advising as to the process to extend the TM
90-04 standard agreement.
