A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
ACCEPTING THE GRANT IN FEE TITLE OF LOTS 48, 49 AND 50 OF CITY OF
POWAY TRACT NO. 85-04 (TTM 85-04), UNIT 1, MAP NO. 11742, AND LOTS 105
AND 106 OF TTM 85-04, UNIT 2, MAP NO. 12572
WHEREAS, W.H. Pomerado, LLC, a California Limited Liability Company,
offered to the City of Poway (City) the transfer of title of Lots 48, 49 and 50 of TTM 85-
04, Unit 1, Map No. 11742, and Lots 105 and 106 of City of Poway Tract No. 85-04, Unit
2, Map No. 12572; and
WHEREAS, W.H. Pomerado, LLC is the owner of record of the above described
properties as of the date of this instrument; and
WHEREAS, these properties are designated, in whole, as open space
easements which were dedicated to the City through the final maps of Map Nos. 11742
and 12572, recorded in the office of the San Diego County Recorder on March 9, 1987
and January 28, 1990 respectively; and
WHEREAS, W.H. Pomerado, LLC has executed a Grant Deed conveying title of
these properties to the City which will be recorded in the office of the San Diego County
Recorder after adoption of this Resolution; and
WHEREAS, upon transfer of title to the City, the open space easements and all
other existing City easements within these properties shall be extinguished.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Poway
as follows:
Accept the grant in fee title from W.H. Pomerado, LLC of Lots 48, 49 and 50 of
TTM 85-04, Unit 1, Map No. 11742, and Lots 105 and 106 of TTM 85-04, Unit 2,
Map No. 12572.
2. Direct the City Clerk to record the Grant Deed conveying fee title interest to the
City of the abovementioned properties.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of
Poway, California, at a regular meeting this 2nd day of October 2001.
